incident. Vinfen Corporation is the largest provider of human services in the New England states. Their President earned in 2003 $325,000 plus benefits. I called inquire why his salary was so high. The first two calls were referred to their PR flack, who did not reply to my voice mail messages. The third tie I called he spoke with me saying "Vinfen is non profit." I said I knew that but what does that have to do with such high salaries. He repeated the fact that "We're non profit." Then he told me to stop calling because I was annoying the secretaries. It is one way of discouraging exposing abuses by non profits, and of covering up racial incidents by democratic politics.

Department of Justice Moves to Protect Medicaid Defrauders: Court Sets Hearing for April 7th
Due to the massive amount of harm inflicted on children and youth, in July of 2009, the Law Project for Psychiatric Rights (PsychRights®) launched its Medicaid Fraud Initiative with a model Qui Tam Complaint for people to use around the country. This initiative combines Medicaid's coverage restriction of outpatient drugs to those that are for a "medically accepted indication" and the right of people to sue on behalf of the government and share in the recover, if any under the False Claims Act.
The Department of Justice has recovered billions of dollars from drug companies for causing false claims at Step 1 of the Fraudulent Scheme, but have declined intervention involving defendants at Steps 2 & 3 in two Alaska cases, as well as the ex rel Nicholson case in Illinois.[1]
In a surprising action, however, on March 7th, the Department of Justice actively moved to protect alleged defrauding defendants at Steps 2 & 3 by asking the judge to dismiss the ex rel Nicholson case for what appears to be disingenuous reasons. Randy Kretchmar, Ms. Nicholson's attorney, said, "We have offered to address their concerns through agreement and they have thus far failed to respond. This reinforces the view stated in our opposition that the motion to dismiss is disingenuous."
As background, in 2007-2008, there were two suspicious letters on the letterhead of the agency charged with administering the Medicaid program, the Centers for Medicare and Medicaid Services (CMS), that assert Congress did not limit outpatient drug coverage under Medicaid to those used for a medically accepted indication.[2] This is directly contrary to the formal position of the United States Government, taken in a number of False Claims Act cases against drug companies.[3]
Law Project for Psychiatric Rights president Jim Gottstein in speaking with a US Attorney was told that even though they are false claims, the government would decline to intervene in that jurisdiction if a case was brought against a doctor or pharmacy as a matter of prosecutorial discretion. In the Alaska cases, the local US Attorney's office appeared to be taking its direction from CMS.
In light of this, PsychRights asked Eric Pruitt, the Assistant United States Attorney who filed the motion to dismiss on behalf of the United States Government, the following questions:
- Why shouldn't it be concluded the Department of Justice and CMS are protecting prescribers and pharmacies for their participation in this continuing massive fraudulent scheme?
- Does CMS take the position that prescriptions not for a medically accepted indication are covered under Medicaid?
- Is CMS calling the shots on the Department of Justice's response to the qui tam cases against prescribers and pharmacies for causing and presenting false claims to Medicaid for psychotropic drugs used on children and youth that are not for a medically accepted indication?
- Do the Department of Justice and CMS consider only the economic point, i.e., the drug companies have deeper pockets, or are they attempting to make an independent judgment that somehow psychiatrists and pharmacists are less culpable for the same fraud?
- Even if so, why is CMS still paying these false claims on a massive scale?
Mr. Pruitt declined to answer, saying "We do not comment on pending cases:"
In response, Mr. Gottstein said, "The public is entitled to know the answers to these questions. Obtaining large recoveries from drug companies is an ineffective sanction, because the fraudulent prescribing practices are continuing unabated. It appears the Department of Justice is now actively protecting doctors and pharmacies committing Medicaid Fraud ."
The court has set a hearing on the government's motion for April 7th at 9:25 am, Room 1725, 219 S. Dearborn, Chicago, Illinois.

In your letter to the President dated March 14, 2011 you say,
"In the case of Tucson, a man clearly bent on violence was not reported to the proper authorities by those who had good reason to believe he had serious mental problems. That's not a deficiency in our gun laws, it's a deficiency in our mental health system -- and should be treated as such.

We welcome any serious discussion on policies that focus on prosecuting criminals and fixing deficiencies in the mental health system. Any proposals to the contrary are not a legitimate approach to the issue."
I support your efforts defending the Second Amendment. I know about the research in John R. Lott Jr.'s book More Guns, Less Crime.
Your general statement regarding the mental health system is problematic. Psychiatry is personal opinion masquerading as science. It is a large and growing boondoggle. Mental illnesses are created by consensus, not science. There are no pathologies for mental illnesses. Only psychiatrists can see mental illnesses. They diagnose symptoms, i.e., speech and behavior that are protected by the First Amendment to US Constitution. Speech and behavior that psychiatrists do not like or do not understand is declared mental illness. Psychiatry is a means of social control with no due process protections.
The Constitution protects citizens from arbitrary abuses of government power. Stalinist and Nazi psychiatrists made good use of the arbitrary nature of psychiatry. Yet many believe the genes of American psychiatrists have been cleansed of mendacity, greed and sadism.
Why do psychiatrists have an exception to the protections? Why do courts allow psychiatrists to predict the future? American jurisprudence defines crime as an act accompanied by the knowledge that the act is wrong. Taking freedom based upon personal opinion (psychiatry) is government abuse.
Your refer to "those who had good reason to believe [Loughner] had serious mental problems," without explaining who "those" are. Journalists regularly cite "a history of mental illness," when reporting crime. They suggest and share the fantasy with prosecutors that mental illness causes crime. Politicians believe that guns cause crime. It is just as nonsensical to blame mental illness for violence as it is to blame guns. But that is what your letter appears to do.
The psychiatric industry and the drug companies use their enormous influence promoting psychiatry and drug treatment. They control legislation and most editorial positions regarding mental illness and taking freedom based upon personal opinion and irrational fear.
The current focus is turning prisoners into mental patients, which is good for the drug companies and the psychiatric industry but bad for citizens. There is no appeal from a medical diagnosis. It was the Nazis who medicalized social problems. Research shows that fatherless children are much more likely to have problems with the criminal justice system than those with fathers. That is the source of much of the problems in the US today. But there is little focus on solving that problem. Instead fatherless homes are celebrated.
Why does the NRA divert attention from one scapegoat to another? People do bad things. It is impossible to identify violent civilians. Everyone is a potential criminal.
I hope you will reconsider your stated assumption regarding psychiatry.

Harvey Silverglate makes a cogent argument indicating prosecutors and the judge abused their power in sentencing Chuck Turner. Turner is a member of the Green Party, a fact seldom mentioned in public discourse. There is an intense animus toward political efforts outside of the two-party system. Tea Party groups are demonized. The judge used newspaper articles as evidence. Is a statement reported in the newspaper accepted as fact? US law enforcement agencies have a sordid recent history prosecuting innocent people and allowing homicides by their employees. Journalists have a history of printing false statements too. The sentencing of Turner compared with the sentencing of the wife of US Rep. Tierney, House Speakers Finneran and Flaherty shows there is a substantial unevenness in the delivery of justice in MA. The arrests of 100 alleged crime family members in New York, New Jersey and Rhode Island shows that the current department of justice selectively enforces laws, and racially profiles.
