Boston Police Join Harvard University Campus Police In Misguided Notion of Jurisidction






"Myeshia Henderson, a spokesperson for the Boston Police Department, said one building—Aldrich Hallfell under BPD’s jurisdiction. Their office received word of a bomb threat at 10:38 a.m., she said, and officers are currently investigating at 35 Harvard Way." This indicates that Boston Police Department has the same misguided arrangement contrary to state law as with the Cambridge Police. Under what system of jurisdiction do Boston police not have jurisdiction in Boston? Do Crimson journalists believe the fantasy promoted by HUPD that they have exclusive jurisdiction on Harvard University property? Are they like the group of young journalists that White House National Security Chief Ben Rhodes said "Know literally nothing?" Are they like the voters and taxpayers that Rhodes called stupid?

Few police departments know what to do about computer crimes. Harvard University campus police are notoriously poorly trained. In Cambridge, MA (where Harvard Law School is located) laws are optional. Harvard University faculty and administrators are protected by the Obama-Holder Doctrine: Inconvenient laws may be ignored by a select few. Emails do not travel remaining in one jurisdiction. Campus police jurisdiction ends at the Harvard University property line. They can hardly investigate lawfully. A great book about the coming tsunami of computer and other technology crimes is Marc Goodman's Future Crimes. Hackers stole $80 million almost got a billion from the Bangladesh national bank last week.

Emails published on a blog run by activists opposed to a racial justice group at Harvard Law School show that the organization, Royall Must Fall, asked the Harvard administration to investigate the anonymous site and discover who is behind it.
The blog, Royall Asses, grew out of an incident last year where pieces of black tape were placed on the portraits of black law professors. The site claimed that the incident was a false flag operation by members of Royall Must Fall.
One member of the racial justice group claimed to have received email threats. She went to the FBI and asked them to monitor the blog despite the fact there was no evidence anyone connected with the blog had sent the threatening emails.
The group also asked law school administrators to find out who was behind the blog.

Royall Asses claims that it came into possession of the two emails because one of the people Williams contacted was appalled that the student activists and Harvard itself would use “Gestapo tactics to invade student privacy.” That student forwarded the emails to Royall Asses.
If Williams’ emails accurately represent Harvard’s actions, then it suggests Harvard attempted to investigate (and potentially expose) its own students simply for running a blog that criticized left-wing elements on campus.

Harvard University Campus Police Indicate Negligent Training




Is this one more example of negligent training of the Harvard University campus police? By statute their jurisdiction ends at the property line of the university. HUPD misguidedly believes they have exclusive jurisdiction on campus and over students. But state law does not agree. Students obey authority and believe their campus badge-wearing-gun-toting officers. 



Cambridge, MA city police are reluctant to keep the lines strictly drawn and permit relaxed jurisdiction for their fellow officers. It makes the job of city police easier. The state executive office of public safety which has jurisdiction over the campus police joins the city council, the city manger and the police commissioner, allowing HUPD to do whatever they want to do with no accountability. One more case of absolute power corrupting absolutely.

Cambridge Police Investigate Indecent Assaults Near Harvard Square




If none of the indecent assaults occurred on Harvard University property how do campus cops obtain jurisdiction? And how do indecent assaults differ from decent assaults?

The Cambridge Police Department are cautioning women who live, work or frequent the Harvard Square area to be aware of a recent increase in indecent assault and batteries.
Officers are currently investigating a report that a woman was indecently assaulted while walking near the intersection of Garden Street and Massachusetts Avenue near Harvard Square on Sept. 8 at approximately 8:30 p.m. The victim said a man bumped into her with his shoulder and then grabbed her butt.

Misguided Idea To Federalize Police

The idea behind federal supervision of local police forces is that it will make them more accountable. Instead of a bunch of presumptively racist, violent hicks running things on a local level, we'll see the cool professionalism of the national government in charge.
There are (at least) two problems with this approach. The first is that federal law enforcement, especially in recent years, hasn't exactly been a haven of cool professionalism. The second is that no law enforcement agency is very good at policing itself, meaning that a national police force is likely to be less accountable, not more. And there's a third problem, too, but we'll get to that in a minute.

Which brings us to the second problem: These police agencies aren't very good at policing themselves. But at least there's the possibility that other police agencies might investigate them more thoroughly. The Secret Service agents in Nashville who requested their phony warrant were busted by the local police chief; the Baltimore police will be investigated by the U.S. Department of Justice. But unify all these police agencies under one umbrella and they'll do what guilty bureaucrats tend to do — hide the evidence, then investigate themselves and proclaim themselves blameless.

The third problem with unifying police authority under a national umbrella is that it's much more prone to political abuse by the party in power. As we've seen with the IRS— which, interestingly, shows little interest in frequent White House visitor Al Sharpton's unpaid taxes — federal bureaucrats are all too willing to serve the interests of their political masters even when doing so violates the law. Putting most law enforcement in the hands of diverse state and local authorities helps limit the potential for abuse. Putting everything under federal control, on the other hand, magnifies it.
Instead, if we're really serious about increasing law enforcement accountability, we should end civil service protections for federal employees, while outlawing public employee unions. We should also abolish governmental immunity for federal, state, and local employees, forcing them to face civil lawsuits for illegal behavior, just as the rest of us must do.

New York City Council Wants To Weaken Police Arrest Powers. FBI Informant, Tax Cheat, Rev. Al Sharpton Agrees




Trickle down economics may not work, but trickle down lawlessness certainly does. After 7 years of a lawless White House and Attorney General, ordinary people are imitating federal officials and their attitudes toward laws. It was only a matter of time before laws became optional under the Obama-Holder doctrine. One concept that politicians seem unable to understand is the the legal notion of jurisdiction. City officials may be able to reduce city ordinances to violations, but state laws are another matter. They just do not have jurisdiction. But again under Obama-Holder omniscient morally superior elitists can ignore inconvenient laws.

The same privileges for prominent black professors exist at Harvard University where campus police harass and arrest people based on black racist priorities. Private Police Out of Control In Virginia As In Massachusetts




Massachusetts special state police fall into this category of private police who operate under state statute. But the Massachusetts Supreme Judicial Court ruled that their records are not public. The chief judge at the time was Margaret Marshal, former General Counsel at Harvard University which employs many special state policemen. They are negligently trained and abuse their authority. Their jurisdiction is limited to the property of their employer, i.e., Harvard University. But they assert their authority on city streets and land adjacent to their property. They use their authority for personal and for political purposes. They do favors for faculty and administrators at the university. There is no way to address their abuses in Massachusetts because of the enormous influence of Harvard University on the state government and currently at the White House.

Like more and more Virginians, Youlen gained his police powers using a little-known provision of state law that allows private citizens to petition the courts for the authority to carry a gun, display a badge and make arrests. The number of “special conservators of the peace” — or SCOPs, as they are known — has doubled in Virginia over the past decade to roughly 750, according to state records.
The growth is mirrored nationally in the ranks of private police, who increasingly patrol corporate campuses, neighborhoods and museums as the demand for private security has increased and police services have been cut in some places.
The trend has raised concerns in Virginia and elsewhere, because these armed officers often receive a small fraction of the training and oversight of their municipal counterparts. Arrests of private police officers and incidents involving SCOPs overstepping their authority have also raised concerns.

In neighboring D.C., a similar designation called “special police” requires 40 hours of training. Maryland officials leave instruction to the discretion of employers but have no requirements. Other states have similar systems.

No ­authority regulates the conduct of SCOPs or addresses complaints against them, although a court can revoke their commissions. The state does not track the number of arrests they make or citations they issue.
Most SCOPs patrol corporate campuses, work for neighborhood associations or perform code enforcement for counties or cities,

A 2012 study from a University of Illinois College of Law assistant professor found that private police are “chronically undertrained” and nearly a third nationwide face almost no regulation.

The Court of Appeals in Albany voted 5-0 to strike down a 2006 Nassau County law that banned offenders from living within 1,000 feet of a school — saying that only the state had the power to enact such a ban.
The decision in the Nassau case set a precedent that will affect more than 100 similar municipal ordinances around the state that set boundaries around parks, schools and other areas where children are likely to gather.
“A local government’s police power is not absolute,” Judge ­Eugene Pigott Jr. wrote. “Although a local government is constitutionally empowered to enact local laws relating to the welfare of its citizens through its police power, it is prohibited from exercising that power through the adoption of local laws that are inconsistent with the New York State Constitution or any general law of the state.”

A backdrop to the massacre in Paris on Wednesday by self-professed al Qaeda terrorists is that city officials have increasingly ceded control of heavily Muslim neighborhoods to Islamists, block by block.
France has Europe’s largest population of Muslims, some of whom talk openly of ruling the country one day and casting aside Western legal systems for harsh, Islam-based Shariah law.
“The situation is out of control, and it is not reversible,” said Soeren Kern, an analyst at the Gatestone Institute and author of annual reports on the “Islamization of France.”
“Islam is a permanent part of France now. It is not going away,” Mr. Kern said. “I think the future looks very bleak. The problem is a lot of these younger-generation Muslims are not integrating into French society. Although they are French citizens, they don’t really have a future in French society. They feel very alienated from France. This is why radical Islam is so attractive because it gives them a sense of meaning in their life.”
While not a complete safe-haven for al Qaeda-type operatives, Paris and other French cities have become more fertile places for Muslim extremists in the past decade. City leaders have allowed virtual Islamic mini-states to thrive as Muslims gain power to govern in their own way.
“There are no-go areas not just in Paris, but all over France, where they are effectively in control,” said Robert Spencer, who directs JihadWatch.org, a nonprofit that monitors Muslim extremists.

“What they are trying to do is shut down any sort of criticism of Islam, any sort of speech, cartoons, discussion, anything,” he said. “Essentially, the French government and the other European governments have lost control over the situation. It’s a snowball that is growing bigger and bigger, in particular over the past 10 years.”

Some Muslim activists gleefully predict that France will be a Muslim-majority country in the not-too-distant future.

Harvard Law School Violates Misguided Education Policies, Pleads For Forgiveness




Sex crimes, police training are state matters. US agencies do not have jurisdiction under US constitution. Obama-Holder-de Blasio-Jeh Johnson and their cadre of useful idiots continue campaign to move state powers to the US government contrary to Tenth Amendment. Emeritus Law Professor Alan Dershowitz recognized appropriateness of a lawsuit by the University to challenge misguided government efforts. White House and Attorney General want to move criminal justice matters from state courts to university administrators and education bureaucrats. What could go wrong? Only Emerson College challenged the capital beltway bureaucrats. Emerson denies they have responsibility to protect students from third party crimes. Too many spineless bureaucrats focused on taxpayer dollar tree, running Harvard University.

US Judge Who Declared White House Immigration Memo Unconstitutional, Was Acting Without Jurisdiction




McCarthy's analysis is that the judge who "decided" that Obama's memorandum to change immigration law is unconstitutional, was himself acting outside of the constitution. The underlying cause of action, of the case before this judge was a criminal matter. Deportation is a civil matter. The judge did not have jurisdiction. But in these days of widespread adoption of the Obama-Holder doctrine, inconvenient laws may be ignored by selected persons, what does jurisdiction matter? The Massachusetts Supreme Judicial Court which legalized same sex marriage did not have jurisdiction over marriage. The state constitution states that matters regarding marriage are to be left to the Governor and the legislature. That did not stop the MA Judiciary, led at the time by Margaret Marshal, the former General Counsel of Harvard University. Perhaps the gentleman from Baltimore and Georgia who shot dead two NYPD officers while they were sitting in their patrol car was inspired by the same lawlessness in Washington DC and Boston. What does equal protection of the laws mean? If politicians can pick and choose which laws to obey, why not the rest of us? Laws are just for the little people. I do not think that shooter thought of himself as a little person.

Judge Schwab, analogously, has run roughshod over constitutional boundaries that limit the exercise of judicial authority. The Constitution empowers judges to resolve only cases and controversies that are actually before the court. In this case, President Obama’s decree was not before Judge Schwab — at least until he gratuitously directed the parties, who had not raised it, to address it.

Academic Lobby Wants To Prosecute Rape on College Campuses




Mollie B. Flounlacker adds some sanity to the discussion recognizing the inappropriateness of the US government making rules on sex, especially the Dept. of Education. But alas she wants to have the AAU make the rules instead by survey. Do the 62 research institutions of AAU have jurisdiction over crime at all universities in the nation, world? Are they expert on rape like the university administrators and the bureaucrats at the DOE? AAU web site says Flounlacker is "Responsible for issues related to the humanities." Can taxpayers stop funding special training for police, prosecutors and hospitals who gather evidence and prosecute rape? Are police now superfluous? Will the AAU take over the entire criminal justice system or just rape? MIT's Jonathan Gruber, Obama's health care law architect, says Americans are stupid, and it was necessary to fool elected officials and voters in order to pass the law. Is the same thing happening with campus rape?

Harvard University Adopts New Standards Under Education Act For Sex Crimes


Harassment, sexual assault, and sexual harassment are state crimes. Under what legal system does the U.S. government, its mind boggling Department of Education and Harvard University administrators get jurisdiction? HUPD has jurisdiction of the above named crimes if and only if they occur on Harvard University property. Did MA state courts or legislature extend power to an administrator appointed by the President and Fellows of Harvard College? Local appointment of judges by city officials occurred when Harvard University professor Henry Louis Gates was arrested by Cambridge police. The private attorney and city solicitor, did not have jurisdiction to dismiss that charge either. But hey, this is Cambridge where the Obama-Holder Doctrine rules -- inconvenient laws may be ignored. Discrimination laws under the civil rights section of the Education Act, do not give adjudication jurisdiction to a college administrator. Will Harvard Law School create a sex court to hold hearings and punish the guilty? Aside from meeting requirements of the misguided U.S. law, in order not to lose taxpayer grants, what is the reason for these new guidelines? Are local and state police, and state courts unable to address these crimes?

HUPD jurisdiction ends at their property line. HUPD and Harvard University administrators promote the fantasy that Harvard University campus police have exclusive jurisdiction on their property. One more example of deception by this prominent university.

The victim told police he was robbed by two men at gunpoint as he walked on Church Street at 2:50 a.m., according to Cambridge Police.
The victim told police he had just met with one of the men when one of them tossed him against a wall. The other man, police said, held what the victim believed was a gun against his head and took his wallet and other personal items.
The two suspects flew down Brattle Street toward Fresh Pond.
The victim was not injured.
Since the incident did not occur on university property, Cambridge Police are investigating the robbery.

Expect them to comprehend the concept of discrimination? 2012 HGSE grad Argetsinger, hotline counselor for a rape crisis center, said "People who are survivors are really aware that peers who have spoken out in the past have received no justice[.]” Is that unique to rape victims? Is sexual assault a federal crime? If state, local police and campus police are unable to protect students from sexual assaults, is the FBI, who allowed crime boss, James Bulger to administer capital punishment without due process in Massachusetts to about 60 victims, better equipped? These are Department of Education bureaucrats who want jurisdiction over campus sexual assault. Is this an example of the Idiocracy taking control of the country?

Civil Rights Office Opens Investigation of College’s Handling of Sexual Assault Cases

A key tool the government has against campus sexual assault is Title IX, which prohibits gender discrimination at schools that receive federal funds. The 1972 law is better known for guaranteeing girls equal access to sports, but it also regulates institutions’ handling of sexual violence and is increasingly being used by victims who say their school failed to protect them. Fifty-one campuses currently have such an ongoing investigation involving sexual violence, the Education Department said.

Another law that campus sexual assault cases fall under is the Clery Act, which requires colleges and universities to annually report crime statistics on or near their campuses, to develop prevention policies and ensure victims their basic rights.

Do men accused of sexual assault enjoy equal protection of the laws? Why then are women getting the primary attention of the U.S. government and the college administrations? Why does the federal government deliberate the meaning of sex assault laws. Is rape a federal crime? More of the confusion of laws and jurisdiction by this racist administration which works hard to destroy the United States as a functioning society. American jurisprudence requires mens rea for a person to be convicted of a crime. Under the standards proposed by the Department of Education under Title IX being imposed on colleges there is no mens rea requirement. Only the accusation. Has the Idiocracy taken over the federal government?

Is there a problem with the Massachusetts State Police? Who needs local police chiefs? Why not dress all police in the same uniform and make them answerable to one chief of police? And why is the Transit police, the MBTA officers, the constables, and the Harvard University campus police not included?

Limiting Campus Police Jurisdiction A National Issue

Campus police around the country are increasingly expanding their jurisdiction beyond the school and into the surrounding neighborhoods, blurring a town-gown divide that colleges say is arbitrary when it comes to crime.

a proposed expansion of authority has stirred concerns in Washington, D.C., where residents say university police don't have the same level of training or transparency requirements as the city police. Campus police officers in the city have arrest powers on campus but participate in a separate, shorter training academy. And because private colleges generally aren't compelled by public records law to release the same information as public institutions and government agencies, some are concerned about a lack of accountability to the city and its residents.
"If one of their policemen acted inappropriately, there would be hardly any recourse. We'd have no information, no follow-up," said Ken Durham

None of this discussion addresses abuses of power which does happen on occasion by misguided officers. In one case at Harvard University an eager ambitious officer did a prominent professor a favor by arresting a person whose constitutionally protected speech and behavior offended the professor. The University refused to address the abuse of power. 

Another element of this is the lack of accountability, and over sight. Private police are answerable only to their employers. Large prominent university corporations, like Harvard University with $32 billion endowment have little respect for eccentric individuals, and critics. They will abuse their power as regular city and state fully trained officers will do. But the lack of accountability creates barriers to uncovering the abuses. At Harvard University, their police have been known to cover up felonies committed by university employees. They also abuse their powers as personal favors. It is important to limit the authority and jurisdiction of these campus police wannabes.

Harvard University and Cambridge Officials Silent About Police Jurisdiction

Two readers of the The Crimson (HUPD officers or employees?) showed their arrogance and ignorance questioning me about HUPD negligent training. As requested I directed them to the state statutes and to the property lines of Harvard University. The response was to retaliate by harassing me at my residence owned and operated by the President and Fellows of Harvard College. That is a felony, a violation of the MA state civil rights statute intimidating a person in the free exercise of a constitutionally guaranteed right. Speaking, writing, criticizing private police is a part of that right. The statute makes it clear it is not restricted to abuse by public officials. HUPD claims they are not public officials. Violations of state laws is what drew my attention to scrutinize HUPD in the first place. Happy New Year! You make my point for me. Not only is HUPD negligently trained but they abuse their power freely, which is the problem with most police, especially those who are negligently trained. Threats to have me "hit" accompany the harassment. 







Secretary of the Administrative Board John “Jay” L. Ellison , "Cat got your tongue?" CPD spokesperson Daniel M. Riviello, and HUPD spokesperson Steven G. Catalano did not explain the archaic notion of jurisdiction. CPD has lawful jurisdiction anywhere in the City of Cambridge. HUPD's fantasy (negligent training) is that HUPD has exclusive jurisdiction on Harvard University property. HUPD does not have jurisdiction to enforce city ordinances, which is what a noise violation is. The City has a poorly written noise ordinance which is always under review and complaints from annoyed concerned citizens. Nuisance and open container laws are state statutes. Would teaching students and others what laws are, and that troublesome concept of jurisdiction, help improve the conduct of city residents and visitors? Would it impact the constitutionally guaranteed and protected right to pursue a better quality of life?
