New York Football Giants Player Sues Reporter For Privacy Violation of Medical Records

One more benefit of the new health care law brought to you by lawless and clueless Democrats. Online medical records are easily accessible to hackers, criminals, and data brokers. See e.g., Marc Goodman's book, Future Crimes.

[From article]
Giants defensive end Jason Pierre-Paul is flagging ESPN and its reporter Adam Schefter for posting his private medical records online to millions of readers.
Pierre-Paul, 27, sued ESPN and Schefter in a Florida court Wednesday, citing a violation of his privacy.
The NFL player blew off a finger in a July 4 fireworks mishap and was treated at Jackson Memorial Hospital in Miami, according to his lawyers Mitchell Schuster and Kevin Fritz.
Schefter “improperly obtained” Pierre-Paul’s medical chart showing the defensive end had his right index finger amputated and posting the record on Twitter to nearly 4 million followers, the suit says.

The reporter said he tweeted the image of the medical record to bolster a story about the surgery.
Schefter, 49, who lives in New York, is a regular contributor to ESPN TV programs like “NFL Insiders,” “Monday Night Countdown” and “SportsCenter.”
Pierre-Paul’s Miami Dade County civil suit, which does not specify money damages, says that while the player’s injury may have been “a matter of legitimate public concern,” the “chart was not.”

Texas Democrats, Unlawfully Reveal Medical Records Of District Attorney, Openly Show Bigotry Toward Persons With Disabilities

David Woo/Staff Photographer
Dallas District Attorney Susan Hawk talks to reporters outside her office at the Frank Crowley Courts building on Oct. 1, her first day back at work after missing more than two months to deal with an episode of "severe depression."

Indicates routine lawlessness of Democrats revealing medical records in violation of privacy laws. But also it shows bigotry of Democrats against persons with disabilities contrary to state and US discrimination laws. No shame for Democrats who openly violate laws, constitutional protections and individual rights.

[From article]
Hawk, a Republican, wanted to resign in July because of suicidal thoughts, according to the magazine. Instead, she spent two months at the Menninger Clinic, a premier psychiatric hospital in Houston.
D Magazine reported that Hawk thought about overdosing on sleeping pills before she checked herself into the mental health facility. While there, she was diagnosed with major depressive disorder, considered strangling herself with a blow dryer cord and, at one point, was officially committed after telling a nurse: “I’m going to kill myself anyway. Just let me go home,” the magazine reported after an interview with Hawk.
Dallas County Democrats responded Sunday by releasing a statement in which they moved beyond nuanced calls for her resignation and explicitly pushed for her ouster.
“Just weeks ago, our top law enforcement official was involuntarily committed after threatening to kill herself. … In view of the facts that have just recently been revealed, Susan owes it to herself, not to mention her nearly 500 employees and the taxpayers, to resign and to concentrate on getting well,” party chairwoman Carol Donovan said.
Hawk clarified Sunday night that she was at the facility “voluntarily the entire time.” The D Magazine story said she checked herself into the hospital but became committed after threatening to kill herself.
“I’m good. I’m healthy,” Hawk told The Dallas Morning News late Sunday. “I’m not going to let this sort of attack get to me or change that. The reason I told my story is because I wanted to help people. It’s that simple.”
[. . .]
Dallas County Republican Party Chairman Wade Emmert shot back on Twitter, denouncing the Democrats as hypocrites for attacking Hawk but supporting Dallas County Commissioner John Wiley Price, who is under federal indictment.

Police Reveal Medical Records, For What Purpose?

Under what system of law does this police spokesman reveal medical records in violation of US HIPAA laws? Is the problem that persons accused of having a disability lose their rights under misguided biased police perception? And under what rational purpose do journalists repeat this privacy violation? How many police officers and journalists have a history of mental illness? Is this the same Baghdad Bob Gibbs who used to mislead at the White House?

Patients' Rights, Abuse of Power

Under what law does the Boston Housing Authority administrator reveal medical records of the suspect? Federal HIPAA laws and MA state laws protect the privacy of patients. Why is this reported compounding the breach? Why does a housing administrator even have access to those records? Because of the pervasive bias against persons accused of mental illness? Why are they denied the same rights extended to other patients? Moreover when did this "diagnosis" occur? Was it after the alleged crime? Suspects of prominent crimes are all too often sent for evaluations. This is good for business for the made-up-illness industry, and exposes the arbitrary nature of psychiatric diagnoses.
A man allegedly shoots his neighbor, fires at police and is taken into custody. Then he is sent for an evaluation? Who is acting "normal" in that condition? This is when psychiatrists come along and make their evaluation? Absurdities piled on absurdities, all wasting taxpayer funds. The criminal laws worked well without the laughable role of psychiatry in the court system. Courts are polluted enough without another layer of bureaucrats sucking taxpayer funds in the name of law. Journalists refuse to scrutinize the boondoggle called psychiatry and refuse to reflect on the known role of psychiatric drugs in causing violence. When will psychiatrists be indicted for the murders they cause?

What is the Connection?

What is the connection between crime and alleged mental illness? The Post reports
(1) the "wife of a millionaire mattress king had a screaming match with her mentally disturbed son the day before she was found dead." and
(2) Eduardo "has a history of mental problems" and
(3) "authorities had him undergo a psychological evaluation [. . .] because he was 'incoherent,' a law-enforcement source said."

How does the Post know this is true? Was there a violation of the privacy laws? If not how reliable is the information? Even if reliable why is it reported? Police are the source of an alleged medical evaluation. This appears to be a violation of the HIPAA laws. Why are privacy rights of persons accused of mental illness not treated the same as say homosexuals and politicians? Is there institutionalized bigotry among journalists?

TMZ Courtney Love, Police Psychiatric Abuses

TMZ Courtney Love, Police Psychiatric Abuses

[Harvey Levin is the Producer of the online, and TV gossip show TMZ.]

Hello Harvey Levin,

I posted the below comment on your site below your story about
Courtney Love. I am hoping that you will reevaluate the way that you
report on psychiatric abuses. I saw what happened to Britney Spears.
Did you notice that about 8 employees of that hospital were fired for
releasing Britney's medical records? That is a violation of the HIPAA
US laws. Why do you as a lawyer and your wildly entertaining web site
and TV show not recognize the government abuse of celebrities? Taking
a person's freedom without having committed a crime is an outrage.
Taking her freedom based upon the opinion of a doctor without any
ability to appeal nor any right to an arraigment within 24 hours is an
abuse of police powers.
Now regarding Courtney Love who you and the police say has a
disability is ignored when she complains about theft? What are you
thinking?

Roy Bercaw - Editor ENOUGH ROOM

Regarding Courtney Love as if she has a mental illness, gives to her
all of the protections of city, state and US laws on disability based
discrimination. It is as illegal as racism, sexism, homophobia and
ethnic discrimination. If the police ignore her complaints because
they say she has a disability they are violating all of the laws that
prohibit such bias. That includes but is not limited to the Americans
with Disabilities Act, the Rehabilitation Act of 1973, and many other
statutes. It does not matter legally if she actually has a disability.
What matters is that the police think she has one and deny her access
to police services and protection because of their perception. These
laws extend the equal protection of laws, Amendment 14 to persons who
are regarded as having a disability as well as those who have a
disability or have a history of having a disability. Psychiatrists
make up illnesses by consensus. Psychiatry is a business of personal
opinions masquerading as science. It is a means of social control
without due process protections. It is the easiest method of
discrediting a person for theft or to destroy a career or reputation.
I watch TMZ often. I write about discrimination toward persons with
disabilities in the media. But what is an outrage is that government
officials openly violate discrimination laws against persons with
disabilities and no one questions the unlawful abuses. If the TMZ
report is accurate this is an example of the police denying protection
to a person they perceive as having a disability.
The free use of hateful words about persons who are accused of mental
illness is shameful. But few journalists give equal status to hate
against persons with disabilities as they do for persons of color.
That indicates another form of discrimination by journalists.
