A mentally ill man got a beat-down from cops after excitedly screaming, “Get him, Batman!’’ while watching “The Dark Knight Rises’’ with his sister in a Bronx movie theater three years ago, court papers allege.
Moses Flores Sr.’s only mistake was in choosing a theater seat right in front of an obnoxious off-duty cop, according to the suit.
After Flores, 42, innocently shouted out during the Christian Bale flick in July 2012, NYPD Officer Nelson De La Rosa tapped his shoulder and told him to shut up, the Manhattan federal court suit says.
Flores, who is bipolar and suffers from anxiety, quickly fled the theater with his sister and her pal because he didn’t want any trouble — but De La Rosa followed him out and called emergency-service-unit cops, his suit states.
Flores’ sister “shouted to the officers that her brother is mentally ill, that he suffers from panic disorders, anxiety, and that he should be approached in a peaceful, quiet, and calm manner, that he needs special accommodations, not to threaten him with physical violence or crowd around him,” according to the suit.
“[The sister] watched, afraid officers were killing her brother, as many of them jumped on Mr. Flores and smashed his head and stepped on his neck,” states the suit.
