Psychiatry and Due Process Rights

Taking a person's freedom requires Due Process under the Fourteenth Amendment to the US Constitution. Psychiatry bypasses those rights under laws passed by legislators who are paid by the psychiatric industry, the drug corporations and other interests of controlling and reducing freedom. The laws which deny Due Process rights violate those rights. Allowing the laws to remain makes acceptable a double legal standard for taking freedom. One for persons with disabilities and one for persons without disabilities. It is no different from the double standard based on race, religion, poverty. Here is one example of abuses of the Constitution and denial of Rights guaranteed by it to one man in the name of psychiatry.

Does the Secret Service jail dissenters in mental hospitals?

Back on June 21 of 2004 Secret Service agent Ray LeBeau asked the Phoenix police to arrest Kevin Walsh and take him to a mental institution. Secret Service agent Ray LeBeau said more or less that Kevin was crazy and needed mental help. This can be confirmed by reading the police reports on pages 5 thru 7. The Phoenix police arrested Kevin at an apartment complex in Tempe, then describe how they attacked kevin and took his gun away from him, and later took Kevin to the Maricopa County psych ward as requested by Secrect Service agent Ray LeBeau.

Bryon Wells in a Mesa or East Valley Tribune article on Tueday June 29 also wrote that the Secret Service had arrested Kevin Walsh and jailed him in a Mesa mental institution.

Also in both the phoenix police reports, and Bryon Wells' article in the Tribune it the Secret Service (Ray LeBeau) also said that Kevin Walsh made a threat on the life of the president of the United States. Kevin denied making any threats about the president in the Tribune article. It has been 9 months since Kevin was locked up by the Secret Service but they have not charged him with any federal crimes. My question is that if the secret service had the "probable cause" to arrest Kevin for threatening the president how come they did not arrest him and charge him for that crime? Myself, I don't think they ever had the probable cause needed to arrest Kevin.

About monday June 7 secret service agent Ray LeBeau called Kevin Walsh's home and asked him to contact him at (60.... According to a message Kevin posted on the ASH sig Kevin called the number and left a message to Agent Ray Lebeau telling him that he didn't want to speak to him and asking Ray LeBeau not to bother Kevin's family any more. The Phoenix police report also says that Agent Ray LeBeau wanted to talk to Kevin but that Kevin refused to contact him. My big question on this is how did the Secret Service have any evidence that Kevin was crazy if the Secret Service never spoke to Kevin Walsh?

According to Kevin Walsh after he was in the mental hospital for about 3 to 4 months the Secret Service did subpoena his mental health records. I suspect that was a fishing trip to see if Kevin's doctors got Kevin to admit threatining the president. I don't think they got any evidence because it has been 9 months since Kevin's initial arrest and Kevin has not been charged with any federal crimes.

Why would the Secret Service jail political disenters in mental instutitions? Probably because it is a damn easy way to lock someone up forever without convicting him of a crime.

Under ARS 36-520 anyone can request that a person be declared insane and locked up.



36-520. Application for evaluation; definition A. Any responsible individual may apply for a court-ordered evaluation of a person who is alleged to be, as a result of a mental disorder, a danger to self or to others, persistently or acutely disabled, or gravely disabled and who is unwilling or unable to undergo a voluntary evaluation

Once you have asked the person to be locked up, ARS 36-525 allows the police to jail him without any evidence execpt for the fact that someone said he was insane.

And at the person's court hearing if you can get one judge (that's one judge, not a jury of 12 people) to agree that the person is insane the judge can jail the person for three months to a year without all the hassles of having a jury trial or convincing anyone other than the judge that the person is insane. the judge can jail the person for 90 days if he thinks the person is a danger to himself, 180 days if a danger to others, 365 days if gravely disabled. That sure sounds a lot easier than digging up some non-existent evidence that Kevin threatened the president.

The Secret Service never said in the police reports exactly what they claimed Kevin threatened to do to the president of the United States, nor did the say who told them that Kevin threatened to kill the president of the United States.

According to Kevin, he never threatened the president. Kevin said a Republican phone solicitor called his family and asked them to support and vote for to keep President Bush in office for four more years. Kevin did say that he told the phone solicitor that he "wished the president were dead", something that is probably stupid to say but perfectly legal. The phone solicitor was also at the hearing where Kevin was declared insane, but Kevin's lawyer prevented the phone solicitor from testifying because he said it would be heresay evidence.

How did the Secret Service come to the conclusion that Kevin Walsh is crazy and needs mental health care? I dont know. That wasn't stated in any of the articles? The Secret Service never gave any info on why they made the claim. Kevin has not given me any reasons on why the Secret Service would say he is crazy.

What type of crazy has the court classified Kevin as?

Probably schizophrenia, because the drugs they are forcing Kevin to take are commonly used to treat schizophrenia.

[The two psychiatrists who testified at my hearing both claimed I had the "psychotic disorder, not otherwise specified," which is to say they thought I was mentally ill but could not figure out what illness I supposedly had. When risperidone was ordered for me, I asked if I was considered schizophrenic, but I was told I was not. Eventually I was told I had been diagnosed as having the delusional disorder. --Kevin Walsh]

What is schizophrenia? It is a broad cover-all illness. It can be any thing from being "paranoid" to the extreme of being a "manaic depressive" or "bi-polar disorder" which is the new politically correct term for it.

Schizophrenia is also a "cover-all term" if they don't know what's wrong with you, they call you schizo. The doctors themselves will tell you they don't have a good understanding of schizophrenia but see this web page for more details.

Stigma is No Barrier to Treatment


After many years of PR flacks promoting the idea of stigma, the National Alliance for the Mentally Ill (NAMI) promotes the idea that stigma prevents people from seeking treatment. Contrary to that paradigm are state and US laws (Americans with Disabilities Act of 1990, Rehabilitation Act of 1973), which address discrimination, which denies to persons PERCEIVED as mentally ill (i.e., having a disability) from enjoying the same rights and privileges as "normal" persons. NAMI does not address this perspective at all. They remain focused on promoting drug treatment because they receive major funding from drug corporations. See e.g.,

A couple was invited to a swanky costume party. The Mrs. got a terrible headache and told her husband to go to the party alone.
He being a devoted husband protested, but she argued and said she was going to take some aspirin and go to bed and there was no need for his good time being spoiled by not going.
So he took his costume and away he went. The wife, after sleeping soundly for about an hour, awakened without pain and, as it was still early, decided to go the party.
Since her husband did not know what her costume was, she thought she would have some fun by watching her husband to see how he acted when she was not with him.
She joined the party and soon spotted her husband cavorting around on the dance floor, dancing with every nice woman he could, and copping a little feel here and a little kiss there.
His wife sidled up to him and being a rather seductive babe herself, he left his current partner high and dry and devoted his time to the new babe that had just arrived. She let him go as far as he wished ,naturally, since he was her husband.
Finally, he whispered a little proposition in her ear and she agreed.
So off they went to one of the cars and had a quickie.
Just before unmasking at midnight, she slipped away, went home, put the costume away and got into bed, wondering what kind of explanation he would make for his behavior.
She was sitting up reading when he came in, and she asked what kind of a time he had. He said: "Oh, the same old thing. You know I never have a good time when you're not there."

Medicaid Fraud Initiative Against Psychiatric Drugging of Children & Youth


Because of the massive, harmful, increase in the psychiatric drugging of America's children & youth, who are inherently forced, PsychRights has made addressing the problem a priority.

As a result of working on the PsychRights v. Alaska case (see, below), we realized at least a majority of psychiatric drugs prescribed to children and youth submitted to Medicaid are fraudulent. This is a technical analysis of the Medicaid Statutes alerted to by one of Ed Silverman's Pharmalot blogs and tracking down some 2007 correspondence between the Utah Attorney General's Office and Medicaid.

More specifically, it is fraud if reimbursement from Medicaid is sought for prescriptions of psychiatric drugs given to a child or youth that is not for "medically accepted indication." "Medically accepted indication" is defined as an indication approved by the FDA or supported by a citation in at least one of three specific compendia, the (i) American Hospital Formulary Service Drug Information; (ii) United States Pharmacopeia-Drug Information (or its successor publications); or (iii) the DRUGDEX Information System (Compendia).

PsychRights has developed a Model Complaint (contact PsychRights (address below) or this blog (address above) for a copy) set up for a former foster youth to sue the doctor(s) prescribing the offending drugs, their employer and the pharmacy(ies) submitting the fraudulent claims on behalf of the federal government to collect for this fraud and share in the recovery, if any. However,it can easily be adapted for anyone with "non-public" information (ie., specific offending prescriptions).

PsychRights is optimistic this approach can have a major impact. There have been billion dollar drug company payments to the government for illegally promoting such prescriptions, but that hasn't really touched the harmful practice because (1) it is just a cost of doing business to the drug companies, (2) the doctors have been indoctrinated to prescribe these drugs, and (3) Medicaid continues to pay for the prescriptions even though they have been prohibited by Congress.

We think that once the doctors realize they are subject to financially ruinous Medicaid Fraud judgments against them, the practice will stop or be substantially reduced. PsychRights made presentations about this to the national conferences of the National Association of Rights Protection and Advocacy (NARPA) and the International Center for the Study of Psychiatry and Psychology (ICSPP) in order to find people who were potentially interested and willing to pursue such cases. This was successful and we have at least a few such cases cooking. Lilly v. Gottstein (Zyprexa Papers)

In December of 2006 Jim Gottstein subpoenaed documents that had been kept secret in the litigation over Zyprexa causing diabetes and other metabolic problems and released them to various people, including New York Times reporter Alex Berenson when Lilly failed to object in time. This resulted in a number of front page New York Times articles and reportedly caused the federal investigation into Lilly's illegal off-label promotion of Zyprexa to "gain momentum," which ultimately led to Lilly pleading guilty and paying $1.4 Billion in civil and criminal penalties earlier this year. Even though Lilly screwed up by letting Gottstein get the documents, it spent millions of dollars in attorney's fees to go to the federal court in Brooklyn and get the judge to find he had "conspired" to "steal" them.

This set Gottstein up for Lilly to threaten civil and criminal contempt sanctions and to go after his license to practice law. However, because Gottstein believes he did nothing improper, he appealed this ruling and after numerous delays, briefing is just about complete. He wouldn't expect a ruling until late next year at the earliest. His legal fees in defending against Lilly's legal onslaught have so far been just under $300,000, including estimated unbilled fees, of which he still owes over $141,000. Of the $177,000 paid to date, some $42,000 has been paid through generous donations to the legal defense fund the International Center for the Study of Psychiatry and Psychology (ICSPP) set up. Bigley v. Alaska Psychiatric Institute

FYI, Mr. Bigley is the person for whom Gottstein subpoenaed the Zyprexa Papers in late 2006, and whose representation the federal court in Brooklyn declared was a pretense. PsychRights has represented Mr. Bigley in a number of cases, both at the Superior Court level and in front of the Alaska Supreme Court, some of which ended up being public and some of which have not.

In this case, which is public, PsychRights challenged a number of aspects of Alaska's forced drugging assembly-line regime. In the trial court we were denied access to Mr. Bigley's medical records until after the forced drugging hearing had started, which the Alaska Supreme Court ruled a violation of Mr. Bigley's Due Process rights. We also had very short notice, which we also claimed denied Mr. Bigley's Due Process rights, but while the Alaska Supreme Court said there could be situations in which the amount of time given to prepare would be a violation of Due Process, because we had mounted a serious challenge in spite of the short notice, Mr. Bigley had not been prejudiced by the short notice.

We also challenged the sufficiency of the forced drugging petition on Due Process grounds. Under the Myers case, which we won in 2006, the Alaska Supreme Court held that Due Process prohibits the state from giving psych drugs to someone against their wishes, unless, in addition to finding the person incompetent to decide to decline them, the state proves the drugging is in the person's best interests and there are no less restrictive alternatives. The Alaska Supreme Court then ruled the trial court had to consider certain specific factors, to wit: the patient’s symptoms and diagnosis; the medication to be used; the method of administration; the likely dosage; possible side effects, risks and expected benefits; and the risks and benefits of alternative treatments and nontreatment. Our challenge was that the petition did not include any information on these factors and therefore Mr. Bigley's Due Process rights to notice of what he is being charged with and a reasonable opportunity to respond were violated. The Alaska Supreme Court agreed.

Our other major issue was to flesh out what it means for the Alaska Supreme Court to have said in Myers that the state can't drug someone against their will "if there is a less intrusive alternative available." In particular what does "available" mean? We argued that it didn't mean the state could just choose not to fund it and therefore it was not available. We also argued the state was required to provide the less intrusive alternative that we presented to the trial court. The Alaska Supreme Court didn't order the state to provide the less intrusive alternative, but said that if such an alternative was "feasible" (accepting the trial court's finding that it was not in this case), the state's only choices were to provide the less intrusive alternative or let the patient go.

The ruling that a less intrusive alternative is "available" if it is "feasible" is hugely important. It is somewhat disappointing that the court didn't order the state to provide it, but this is an area of the law we might get the Alaska Supreme Court to take another look at because it doesn't make sense in a certain regard. This is because the issue only comes up when a patient has been found by the court to be so dangerous to self or others that the court has found safety requires the person to be locked up. Saying that the state can then just let the person go instead of providing a feasible less intrusive alternative is not logical and inherently invalidates the dangerousness finding. The reality is, as we know, the courts rule people are a danger to themselves or others all the time when they are not in order to lock them up, but it seems a reasonable prospect that the Alaska Supreme Court will not approve of this if the issue is presented to it crisply enough.

Alaska Supreme Court Case No. S-13558

In this case, PsychRights filed a lawsuit against the state of Alaska and responsible officials (State) seeking declaratory and injunctive relief that Alaskan children and youth have the right not to be administered psychotropic drugs unless and until:

(i) evidence-based psychosocial interventions have been exhausted,
(ii) rationally anticipated benefits of psychotropic drug treatment outweigh the risks,
(iii) the person or entity authorizing administration of the drug(s) is fully informed, and
(iv) close monitoring of, and appropriate means of responding to, treatment emergent effects are in place, and that all children and youth currently receiving such drugs be evaluated and brought into compliance with the above.

The State responded that they didn't have any control over or responsibility for the psychiatric drugging children in their custody or any responsibility under Medicaid, and moved to dismiss the lawsuit (throw it out of court) on the grounds that PsychRights doesn't have standing (the right to bring the suit) because it wasn't harmed by the State's actions.

The judge went along with the State and dismissed the case. We think the judge is wrong and have filed an appeal. It probably won't be decided until some time in 2011.

Potential Not "Medically Necessary" Medicaid Fraud Case

One of the things that some people have criticized PsychRights for is its failure to frontally attack the current medical model dominating psychiatry, i.e., the notion that psychiatric symptoms are manifestations of a defective brain, such as a chemical imbalances or genes, which has led to drugs as the universal response. When Gottstein presented the "medically accepted indication" basis for Medicaid Fraud cases at ICSPP, Dr. Fred Baughman, the point that there is no basis for medical treatment of psychiatric treatments. Dr. Baughman, is the neurologist with a conscience who has been indefatigable in pointing this out. In thinking about it, I came to realize that just as prescriptions that are not for "medically accepted indications" constitute Medicaid Fraud, so do prescriptions that are not "medically necessary."

Dr. Baughman is very interested in pursuing such a case and we are working on it. Such a case should require the psychiatrist who is sued to go up against Dr. Baughman and probably some of our other experts, in front of a jury, to justify the prescriptions with scientific evidence as being "medically necessary." It is a totally intriguing possibility, I think it presents a way to confront prevailing psychiatric practice's basic premise, and I am grateful to Dr. Baughman for his steadfast advocacy respecting this most basic flaw in the current practice of psychiatry.

Electroshock

Fighting forced electroshock has always been on PsychRights' agenda and the current FDA Reclassification Docket (discussed next) is an opportunity that everyone should seize to try and keep the FDA from reclassifying electroshock machines as safe. In connection with this everyone should read Linda Andre's terrific new book, Doctors of Deception: What They Don't Want You to Know About Shock Treatment. If you want to read it and can't afford a copy, let us know and we might be able to get you one. Advocating against electroshock has taken a back seat to the drugging, but it is also very important and we should all be doing what we can to fight it. PsychRights expects to be working more closely with Ms. Andre and the Center for Truth in Psychiatry on Electroshock to try and get some traction on this issue. For now, everyone should write to the FDA about its current reclassification docket.

FDA Reclassification Docket

The Food and Drug Administration is in charge of regulating medical devices just as it does drugs, including the machines used to give Electroshock. It has allowed these machines to be used on millions of patients over the past generation without requiring any evidence whatsoever that shock treatment is safe or effective! This is so even though shock machines are Class III---high risk---devices, which by law are supposed to be investigated by clinical trials as thoroughly as new drugs and devices just coming onto the market.

The FDA is now supposed to require Electroshock machines to undergo the rigorous PreMarket Approval process (PMA) that is required of new devices, including clinical safety trials, but there is great risk the FDA will downclassify it to the low-risk Class II, without scientific evidence of its safety. The FDA has opened up a new docket for public comment on this and it is important for as many people as possible to write in with their opposition. Comments will be accepted up through January 2010.

Potential Electroshock Medicaid Fraud Case

PsychRights work on Medicaid Fraud regarding the psychiatric drugging of children has also made us realize that a similar approach might be mounted against electroshock submitted to Medicaid as not being medically necessary. PsychRights is just in the preliminary stages of potentially looking at such a lawsuit. This one might be directed at fraudulent researchers. Again, Linda Andre's terrific new book, Doctors of Deception: What They Don't Want You to Know About Shock Treatment is a must read for anyone interested in this topic.

National Organizing

PsychRights has made very good progress in Alaska, winning four Alaska Supreme Court cases since starting in 2003, and while PsychRights Medicaid Fraud Initiative Against Psychiatric Drugging of Children & Youth is a national effort, we have not otherwise gotten much traction in other states. This is because I am in Alaska and can take cases here. In order to do the same sort of thing in other states we need to develop organizational capacity in such states. The way we think it makes sense to organize in other states is to have what we call a "State Coordinator," which can be a person or organization. The key things that need to be done are

* Understand both the law for that state and what is actually happening, in order to determine the legal challenge(s) to pursue.
* Identify cases to pursue such challenges.
* Recruit attorneys and expert witnesses.

PsychRights is insufficiently funded to provide financial support of any significance towards this effort.

It seems probable that we need to recruit pro bono (volunteer) attorneys in most cases and we see the key to that is having a "package" that makes such representation attractive, including a legal analysis. GOUVERNEUR, NY - Congressman-elect Bill Owens was sworn in at noon today.

Owens indicated in a press release that he was now in favor of the bill in direct contrast to his earlier position during his campaign.

According to Politico.com, Mr. Owens assured voters that he felt the public option had no place in the health care reform bill. Contrary to that position, Mr. Owens now indicates that he intends to vote in favor of the bill even though it now contains a public option.

Mr. Owens also indicated during his campaign that he was firmly opposed to cutting Medicare benefits, taxing health care benefits, and increased taxes on the middle class in any way as you can see clearly in the screenshot below, taken directly from Mr. Owens' campaign website.

The House Health reform bill contains sections that cut Medicare benefits, tax existing health care benefits, and increases taxes on the middle class, yet Mr. Owens stated today that he will now vote in favor of those things contrary to what he had promised the voters of NY's 23rd Congressional District that he would vote against.

Mr. Owens indicated in his press release today that "This legislation will reform the insurance industry and provide increased access to affordable healthcare without taxing healthcare benefits, cutting Medicare benefits or raising taxes on the middle class, and that is exactly the direction we need to go."

When The Gouverneur Times attempted to contact Mr. Owens to clarify this information, we received no direct response to our phone or email inquiries. Both FactCheck.org and the Congressional Budget Office agree that HR 3962 contains potentially hundreds of billions of dollars in planned cuts to Medicare, yet Mr. Owens indicates that he supports this legislation and says that it does not cut Medicare benefits. Either Mr. Owens has been snowed or the public is about to be.

HR 3962 also includes a range of various taxes on middle-class families as well as language to repeal tax relief already in place. Has Congressman Owens blindly followed Ms. Pelosi's rhetoric in believing that the end to a tax cut is not the same thing as an increase in taxes or is he hedging his bet with very carefully chosen words?

HR 3962 now also contains language that allows illegal immigrants to be covered under the legislation. When The Gouverneur Times attempted to contact Mr. Owens for clarification of this language, we received no response other than the press release heretofore mentioned. Specifically, we asked if illegal immigrants would be forced to purchase healthcare insurance as citizens will be and whether or not they would be forced to do so at standard rates or if they would qualify for the public option subsidy.

The Associated Press said this morning that: "House leaders said that, in keeping with the Hispanic Caucus' demands, there was not likely to be any prohibition added to the House bill against illegal immigrants shopping in the exchange."

In a speech made to Congress a short time ago, President Obama had stated that the bill would not contain support for illegal immigrants - a statement for which he was called a "liar" by Rep. Joe Wilson. Rep. Wilson was severely chastised for his comment at the time though it would now seem to be true.

The mixed-up mess that was the 23rd Congressional District Special Election was a close race between Democrat Bill Owens and Conservative Doug Hoffman. Many feel that it was unlikely Mr. Owens would have won those crucial few thousand votes if the voting public was aware of his intent with regard to the Health Care bill. The majority of residents in this district do not support the Health Reform bill as it is now written and many feel like they've become victims of a fraud perpetrated by their chosen candidate.

Breaking campaign promises is not unusual for politicians... it's a cliche. This is almost certainly a record though. Mr. Owens broke no less than 4 promises in his first 24 hours in office.
Priorities In Place


It is a high priority of police and journalists to focus on grabbing behinds on the MBTA while no one watches lawyers take their clients' money; courts give favors to their friends; police and psychiatrists take everyone's freedom; politicians give away taxpayer funds to their friends and everybody's happy!

After many years of conflating psychiatry and crime the criminals being held in psychiatric facilities continue their criminal ways. Drug companies persuaded legislatures that psychiatry is the solution to campaign funding. The politicians respond with more laws to allow increased use of psychiatry to address crime. Now the psychiatry is exposed as meaningless. Why spend extra taxpayer funds to get the same results as when crime was treated as crime for less money. Nazi party officials medicalized social problems in Germany as the US is doing now. There is no appeal from a medical diagnosis.

Arguing Against Oneself


Selectively choosing how to get special privileges from government is convenient. In MA the state Constitution makes marriage an issue for the Governor and the legislature. The courts in MA did not have jurisdiction to legalize same sex marriage. The legislature ignored the constitution and a citizen petition and yielded to raw political power of the homosexual lobby. Homosexuals run the FBI for many years. They are not weak as a group. If laws are to be written by judges there is no need for legislators who are supposed to represent the voters and to write laws. The arguments for integration of schools and for abortion are backwards. It was not until the US Congress passed the civil rights acts (plural) that black Americans had strong backing for their rights. A court case can be overturned. It is in the interest of the homosexual lobby to have the legislature legalize same sex marriage. Quick and easy is a short term solution.

Lamenting "laws that allow dangerously sick people to roam the streets" does she support allowing psychiatrists and police taking freedom of persons who say or act in ways that psychiatrists do not like or understand? The woman disrespects the Bill of Rights. Police love that psychiatry lacks due process requirements.
She says he weighed 200 pounds but "His psychosis made him so strong." Huh? She admits that "none [of the prescribed drugs] seemed to work." If psychiatry was science the drugs would cure illnesses. Psychiatry treats symptoms not illnesses which are created by consensus not science.
She objects to "informed consent" for persons accused of mental illness saying "This is absolute insanity, to allow someone who is severely mentally ill to make those kinds of choices.” Here's a problem. "She knew it wasn’t his fault," suggesting it was the fault of an illness. Flip Wilson blamed the devil. What's the difference? Here's another bizarre practice--police enforce psychiatric diagnoses. Why don't they enforce diagnoses of broken legs or rashes? Timmy "came to see [the police] as the symbolic enemy." If a person commits a crime he is liable for the act. If an illness causes crime or violence it is a simple matter to incarcerate all persons accused of mental illnesses which only psychiatrists can see. The FDA warns that psychiatric drugs cause violent thoughts. Psychiatrists admit that stopping taking drugs cause violence. If toxic psychiatric chemicals cause violence if stopped why start? When will journalists scrutinize the violence caused by psychiatry?

“He saved her life,” Claude Desrosiers said of Langone. What evidence is there that any of the wounds were life-threatening? How does anyone know what Carciero's intent was? Maybe he just wanted to show her what pain feels like or how it feels to be fearful. Perhaps it was a teachable moment with no harm intended. Most curious about this incident is the surprising speed at which the DA declared the shooting legal. Why must others go to court and wait in jail to find out if they are innocent of shooting people to death? Who needs courts? Close the courts and save money. Let the DA decide by himself.

Negative Bias Among Academics


On the 11:00 PM newscast on WCVB-TV Channel 5, (ABC Boston Affiliate) November 2, 2009 Boston University Professor of Criminal Justice (identified as a security expert on screen) spoke about the arrest of Francis Pelosi. The suspect alleged to be a sex offender was taken into custody at Boston's Mass General Hospital. In recent weeks there were three violent incidents at that huge Harvard teaching hospital. In one a licensed gunman shot dead a man with a disability.

MGH is getting to be a high crime area like courthouses and city halls. Typically BU's Metropolitan College Professor Nolan a former Boston police officer blamed the violence on people who are mentally ill. This is more evidence of negative bias pervasive among police toward persons with disabilities. He said "People come to Mass General for treatment. Some of them are mentally ill." He implies that all persons accused of mental illness are violent. How can anyone treat a violent person?This generates fear among civilians which benefit only the psychiatric industry and the drug companies whose products psychiatrists promote.

Police must have probable cause to charge a person with a crime and to take their freedom. Under extra legal psychiatric standards a person can be held in a mental hospital without any rational reason. Many lose their freedom only because someone did or said something (protected by the US Constitution) that a psychiatrist or a police officer did not like or did not understand.

Police love psychiatry because they can ignore due process rights. Police and psychiatrists ignore the Americans with Disabilities Act of 1990, the Rehabilitation Act of 1973 and state anti discrimination statutes. Psychiatrists usually do not know or care about the laws regarding civil commitment. They believe if they do not like or do not understand what a person says or does that is sufficient to put them away.

The Christian Against Mental Slavery single issue group's position in that eventual "debate" was set out in 2002. We later set our stall as exhibitors at the 2004 Labour Party Conference, and on our website. We say that the technological monitoring or influence of human thought without consent ought to be declared a crime against humanity.

For seven years now, we have been applying for more-or-less every advertised opportunity to debate this issue in public, with anybody who takes a position contrary to ours. I am therefore delighted that The Sunday Times is again giving publicity to the need for such public ethical debate, a need that our international single issue group identified in 2002, and which Dr Foster at Oxford has also identified more recently.

However, this is far from being the first time since 2002 that a British newspaper has reported a technological thought reading research project, including in the report an academic's quote that public ethical debate about technological thought inference is needed. Whenever this happens, this group usually writes immediately to the newspaper concerned, offering for publication an opening shot in the debate, as today. So far, the newspapers concerned have shown no interest in actually publishing in their pages any of the public debate invited. What are all these letters editors waiting for before hosting debate, I wonder? Blood on the streets? Do they think that the ability of Big Brother to read people's thoughts technologically without consent isn't important enough a development for it to be discussed in the press yet?

Very superficial essay. Dede Scozzafava had no Republican redeeming policies. She was associated with the extreme Left-Wing Working Families party. This essay is misleading at best. Challenger Sylvia P. Glick said “Why is it that most of the people in Cambridge do not know that the city is controlled by an un-elected city manager who has a $4.5 million jury verdict against him?” Most people in Cambridge are too busy. They share the relaxed rectitude of officials they elect. City Manager Healy, "in office for 28 years, [. . .] presided over the maintenance of the city’s AAA bond rating." The three ratings agencies (investigated by the AG of NY and CA) gave Triple A ratings to the credit default swaps which were worthless. "Vice Mayor Sam Seidel, [. . .] named the improvement of the Cambridge Public School system the 'number one issue' of his campaign." Here's an example of what's wrong with this city. Seidel if he is sincere should run for School Committee. As the only candidate or resident that wants to improve the schools, is he courageous or what?

Psychiatric Industry is the Source of Violence


Employees of psychiatric clinics and hospitals are notoriously abusive toward humans in the name of love. Without much provocation or justification they will physically subdue a person and have them evaluated for mental illness. They are on the front lines of recruiting patients to increase the drug companies' client base. Psychiatry is personal opinion masquerading as science. Mental illnesses are created by consensus. No one not even the psychiatrists who do the damage know the effects of psychiatric drugs. They are in effect experimenting on the civilian population with the police power of the state enforcing arbitrary diagnoses. This report shows that Harvard University is reduced to trivializing current events. Rather than discuss matters that have an effect on all Americans The Kennedy School of Government and law professors focus on the most famous disorderly conduct arrest in the history of the world. What makes these people appear to be simpletons and obsessed with race is that they divert attention from public discourse about egregious abuses of police power. For 20 years an FBI informant in Boston was murdering 19 white men and women with the assistance of Special Agents.

When did the Kennedy School of Government have a lecture on that curiosity? The FBI, a creature of statute (i.e., it is not mentioned in the US Constitution) exercised its power framing four white men for a murder of which the FBI knew they were innocent. Two of the men died in prison. Two were released after 30 years.

Did the Kennedy School of Government have a lecture on that delightful episode? A US District Court in MA awarded $101 million to the men and their families. The compassionate Department of Justice refuses to pay. Is this a matter for the study of these elitist good government academics at Harvard? Arbitrary awards for the loss of lives in the state courts is unimportant when measured against a disorderly conduct arrest?

Is the fact that the FBI, the MA State Police and the local police in the Boston area were never investigated after these abuses a matter of interest to the good government types at Harvard? Harvard deceivers join their intellectual colleagues in Cambridge government. The City Manager with approval of the City Council spends $200,000 of taxpayer funds to study the same disorderly conduct arrest of a multi millionaire tenured Harvard professor, only because he is allegedly black. He says he is 56 percent white. So that makes this another black racist issue.

10 Facts Every American Should Know About Speaker Pelosi's 1,990-Page Gov't Takeover of Health Care

Members of Congress and the American people are just beginning to look at Speaker Nancy Pelosi’s (D-CA) 1,990-page government takeover of health care, but it’s already becoming clear just how costly and unsustainable this proposal is. From higher taxes on middle-class families to job-killing mandates on small businesses to cuts in Medicare benefits for seniors, here are 10 facts every American should know about Speaker Pelosi’s 1,990-page government takeover of health care:

1. RAISES TAXES ON MIDDLE CLASS FAMILIES. Speaker Pelosi’s health care bill imposes a range of tax increases on families with income below $250,000, breaking a promise made by President Obama. Tax increases on middle class families include: an individual mandate tax of up to 2.5 percent of income for taxpayers earning as little as $9,350; repeal of a tax break on medicine purchased with funds from an HSA (health savings account); limits to tax relief through FSAs (flexible spending accounts); taxes on medical devices that will inevitably be passed on to consumers; and a new tax on all insurance policies.

2. MASSIVE CUTS TO MEDICARE BENEFITS FOR SENIORS. Despite grave warnings from CBO, FactCheck.org, and the independent Lewin Group that cuts to Medicare of the magnitude included in Speaker Pelosi’s bill would have a negative impact on seniors’ benefits and choices, Speaker Pelosi’s health care bill stays the course and cuts Medicare by hundreds of billions of dollars.

3. NO PROTECTIONS FOR SMALL BUSINESSES. Speaker Pelosi’s health care bill claims to exempt small businesses from the steep eight percent ‘pay or play’ employer mandate. The facts tell a different story. Using Census data compiled by the Small Business Administration, this so-called ‘exemption’ hammers small employers with only, on average, 17 or more employees to new taxes and mandates. The outfits affected employ 70 percent of all small business employees, or 42.3 million workers. Adding to the assault on small businesses, the bill does not index the small business “exemption” amounts, meaning more and more small businesses will be ensnared by this job-killing employer mandate each year.

4. INCREASES THE COST OF HEALTH INSURANCE. Imposing a new $2 billion tax on insurance policies will be passed on to patients in the form of higher premiums. Changes to the Medicare Part D prescription drug benefit will, according to estimates by CBO, will raise Medicare Part B premiums by $25 billion and Part D premiums by 20 percent. And imposing an unfunded mandate on the states to pay for the bill’s Medicaid expansion will shift the burden of this expansion on state taxpayers who may experience tax increases to cover the cost.

5. USES GIMMICKS TO HIDE BUDGET-BUSTING COST, PILES UP DEBT ON FUTURE GENERATIONS. Speaker Pelosi’s health care bill claims to be deficit neutral, but uses budget gimmickry to hide its massive total cost. Working families across America know they cannot simply decide that a bill they get in the mail doesn’t exist, but that’s exactly what congressional Democrats are doing. In order to meet the President’s ‘target’ spending total of $900 billion, Democrats have simply swept costly provisions under the rug, including the $245 billion ‘doc fix.’

6. IMPOSES JOB-KILLING EMPLOYER MANDATES. Additional taxes on employers and new government mandates that dictate acceptable insurance will place new and crushing burdens on employers. These are burdens that will ultimately fall squarely on the backs of workers in the form of reduced wages, fewer hours or lost employment. CBO agrees that "[e]mployees largely bear the cost of... play-or-pay fees in the form of lower wages." According to the National Federation of Independent Business (NFIB), the nation’s largest small business association, an employer mandate of this magnitude will disproportionately impact small businesses, triggering up to 1.6 million lost jobs. Two-thirds of those jobs would be shed by small businesses.

7. TILTS THE PLAYING FIELD IN FAVOR OF THE GOVERNMENT-RUN INSURANCE COMPANY. Speaker Pelosi’s health care bill promises not to give the government-run plan advantages over private insurers in the market, but the opposite is true. The bill provides billions in start-up funding for the government-run plan, and while it requires the plan to repay the money over time it does not require the plan to pay interest on this “loan.” This interest-free, taxpayer-subsidized loan is potentially worth millions of dollars and tilts the playing field in favor of the government-run plan.

8. THREATENS CASH-STRAPPED STATES WITH UNFUNDED MANDATES. Speaker Pelosi’s health care bill swells the number of Americans on the government rolls by expanding Medicaid eligibility. Medicaid is financed through a federal-state partnership, but the bill dumps nearly ten percent of the mandated expansion included in the bill onto the states. States, already struggling with fiscal constraints, would be left on the hook for billions of dollars due to this unfunded mandate.

9. CREATES A NEW MONSTROSITY IN THE TAX CODE. Starting in 2011, Speaker Pelosi’s health care bill imposes a 5.4 percent tax on adjusted gross income above $500,000 for individuals and $1 million for married couples. Yet, the dollar amounts for which the tax kicks in are not indexed for inflation. We’ve seen this horror film before: the Alternative Minimum Tax, another Frankenstein’s monster of the tax code, also wasn’t indexed for inflation and now affects millions of middle class families with incomes below the Democrat’s surtax.

10. MISSES AN OPPORTUNITY TO CURTAIL JUNK LAWSUITS. Speaker Pelosi’s health care bill misses a critical opportunity to rein in junk lawsuits and costly defensive medicine. The bill includes only a voluntary grant program to deal with the medical liability crisis instead of including real reform, which would produce tens of billions of dollars in savings, improve efficiency in our health care system and reduce costs for patients and providers.

Passaic County New Jersey Highest Property Taxes

The average homeowner there has an annual income of $85,088 and pays $7,095 a year in real-estate taxes.
The tax comes to 8.34 percent of income.
This means Passaic residents are paying the taxman about one out of every $12 they earn for the pleasure of owning a home."
