Portland OR Policeman Duty Station Changed After Comment on Black Lives Matter

[From article]
"I am highly offended, and I think other people should be,'' said Teressa Raiford, a community activist involved in Don't Shoot Portland. "I think it's very unprofessional, especially someone in his position.''
Officer John Hurlman, a 24-year bureau veteran, removed the post from his Twitter feed, but a screen shot was caught by others.
His message read, "Black Lives Matter is planning to protest at Lloyd Center on black Friday. Oh joy, stuck late again at work to babysit these fools."
[. . .]
In September 2012, Hurlman sent an email message on his patrol car's mobile computer that went out to the entire police force by accident. It was while he was seated in his patrol car, listening to radio coverage of a news conference where Oregon's U.S. Attorney and members of the U.S. Department of Justice announced that a federal investigation had found Portland police engaged in a pattern of excessive force against people suffering from mental illness.
Annoyed by the outcome, Hurlman intended to respond to another officer's email but sent a message to the entire police force, writing something like, "This is the same DOJ or people who created Waco and Ruby Ridge."

CNN, Los Angeles Times Portray Oregon Shooter as White, Hiding His Mixed Race

“On the left is the selfie Christopher Mercer uploaded to his social media,” the Conservative Treehouse reports. “On the right is how CNN presented the same selfie in broadcast stories about him. Why did CNN need to change the complexion (color) of their broadcast?”
[From article]
CNN also did not show photos of Mercer’s mother, who is black.
The reason CNN altered the photo is obvious: the race of Mercer does not fit the narrative that only white males — and thus white supremacist — can be mass shooters.
A black male shooter is incompatible with the racist Black Lives Matters class warfare agenda pushed by the liberal establishment and its propaganda media.
On Friday, a CNN correspondent, Pamela Brown, cited writings allegedly penned by Mercer where he “rambled about his hatred toward black men,” thus portraying him as a racist or possibly a white supremacist.
The Los Angeles Times also portrayed Mercer as a white supremacist:
A federal law enforcement source familiar with the investigation said, though, that authorities had obtained some of Harper-Mercer’s writings, as well as a note he left behind, suggesting that he supported white-supremacist causes and opposed organized religion.

Oregon Officials Indicate Bias and Conspiracy Against Baker Fined For Not Making Cake For Same Sex Wedding

The Daily Signal has exclusively learned that the government agency responsible for enforcing Oregon’s anti-discrimination law appears to be working closely with a powerful gay rights advocacy group in its case against Aaron and Melissa Klein, owners of Sweet Cakes by Melissa.

[From article]
Communications obtained through a public records request show employees of the Oregon Bureau of Labor and Industries—which pursued the case against the Kleins—participating in phone calls, texting, and attending meetings with Basic Rights Oregon, the largest LGBT advocacy group in the state.
[. . .]
“That’s a clear conflict of interest,” Hans von Spakovsky, a senior legal fellow at The Heritage Foundation, told The Daily Signal.
State agencies have a duty to represent the best interests of the general public, not the interests of one particular advocacy group. The relationship shown by these communications is inappropriate and raises basic questions about the objectivity, bias, and fairness of this agency and its proceedings.
It is unclear what occurred during these meetings and phone calls, but the Oregon Bureau of Labor and Industries commissioner, who is in charge of determining the Kleins’ final punishment, met with Basic Rights Oregon on multiple occasions and purchased tickets costing hundreds of dollars benefiting the advocacy group.
[. . .]
based on The Daily Signal’s findings, lawyers for the Kleins on Friday requested the case be re-opened for further investigation.
[. . .]
on Spakovsky, who is a critic of the administrative law process, says the relationship between Avakian and an activist group would be an obvious ethics violation in a normal court system.
“The problem with administrative law judges appointed by a government agency is that they have an inherent conflict of interest—the agency is acting as judge, prosecutor, jury, and executioner, which is a basic violation of fundamental due process protections,” he said.
The whole point of having an independent judiciary is to separate the judicial and prosecutorial functions and avoid this type of conflict.
[. . .]
Suspicious of potential collusion, Harmon, the Kleins’ lawyer, requested the judge allow her to further investigate the state’s relationship with Basic Rights Oregon.
“We argued that because of Aaron Cryer’s testimony, the judge should allow us to re-depose the complainants and even people at BOLI [Bureau of Labor and Industries] to figure out exactly what happened and if there was any collusion,” Harmon told The Daily Signal.
On March 17, 2015, the judge denied that request.
[. . .]
In some ways, the information The Daily Signal obtained is nothing new.
“We knew from Facebook and other public records that the bureau’s commissioner—the final decision maker in this case—is a big supporter of Basic Rights Oregon and that [the Bureau of Labor and Industries] and Basic Rights Oregon are in regular communication about different issues within the commissioner’s control,” Harmon said.
That knowledge dates back to February 2013, when Avakian publicly accused Aaron and Melissa Klein of breaking the law before hearing any evidence

Oregon Judge Orders Payment of $135,000 For Damages After Refusal To Bake Cake For Homosexual Wedding

An administrative law court in Oregon ruled earlier this year against the Klein's defense that their constitutional right to expression of their religious beliefs superseded Oregon state law against discrimination.

[From article]
The Klein's said that 'Satan's really at work' after 'he administrators of gofundme because they claimed it was raising money for an illegal purpose'.
The family will still receive the $100,000 they raised, though it is now urging potential donors to give them money on a fundraising site run by Franklin Graham, son of evangelist Billy Graham.
[. . .]
The Kleins, who closed their store in 2013 amid attention drawn to the discrimination and now operate it from their home, have said that they and their five children are struggling financially.
'This is real money that Aaron and Melissa are going to have to pay that otherwise would be used to pay their mortgage and feed their kids,' their lawyer Anna Harmon told the Oregonian.
The bakery's Facebook page posted a message Friday saying that the fine 'will financially ruin us'.

Oregon Man held in Jail 900 Days, Did Not Commit A Crime

A Washington County Jail inmate walks around an enclosed rec area in his unit. Benito Vasquez-Hernandez, who is housed in general population, has access to a similar space during the day.

Photo: Benjamin Brink/Staff

[From article]
At 897 days and counting, the 58-year-old may be the longest-held material witness in Oregon and perhaps the nation. He's waiting to testify in a murder case.
Legal experts are aware of no other witness jailed for so long. While no one appears to systematically track such cases, a law professor recalls only one similar instance - more than a century ago, in California.
In Oregon, a judge can keep material witnesses in custody until they testify, or release them pending trial. Under state law, material witness holds have no expiration, but detention typically lasts less than a week.
Civil rights advocates say a witness should never be locked up for long - certainly not more than two years. But it's not only the extraordinary length of Vasquez-Hernandez's imprisonment that disturbs them.
It's also his staggering disadvantages. He's poor. He's had no formal education and can't read or write. He's an immigrant who doesn't understand the American justice system. He's had no contact with his family.

Governor of Oregon Resigns

[From article]
Kitzhaber, 67, did not appear in public on Friday and neither did his fiancee, Cylvia Hayes. Instead, he issued a page-long statement that was released Friday that made clear his pain and frustration with having to abandon what was to be a historic fourth term. Yet, he wrote, he understood why the move was necessary.
Criticism had mounted in recent weeks over how Kitzhaber had handed Hayes' roles as an unpaid clean energy and economic policy adviser in his office, and as a consultant paid to promote the same topics. Since Kitzhaber took office in 2011, Hayes had collected at least $213,000 from contracts, records showed.

Upskirt Photography of Teenagers In Oregon Is Not Illegal

[From article]
But his defense lawyer, Mark Lawrence, argued Buono didn't violate the laws against invasion of privacy and attempted encouraging child sexual abuse, a child pornography count.
The privacy law bans clandestine photography in bathrooms, locker rooms, dressing rooms and tanning booths, but the Target aisle was plainly public, Lawrence said.
Upskirt sightings can occur by happenstance, he said, citing a famous photo of Marilyn Monroe with her dress flying up. And that could happen to someone riding up an escalator, taking a spill or exiting a car, he said.
"These things are not only seen but video-recorded," Lawrence said. "It's incumbent on us as citizens to cover up whatever we don't want filmed in public places."
The privacy law also specifies nudity, and the girl was wearing underwear, Lawrence said.
[. . .]
The judge called his decision to acquit Buono "upsetting to say the least."

Muslim Teen Gentleman, 19, Charged With MakingThreats Against Jews in Portland, Oregon

Abdalah Mohamed, 19

Don't forget, this is not religious hatred, nor religious based. The Secretary General of the United Nations said so.

[From article]
Abdalah Mohamed also is accused of making disparaging remarks about Jews and Israel in July, according to an arrest warrant affidavit.
[. . .]
Court records indicate he's lived in Northeast Portland for about six years and is originally from Kenya.
[. . .]
According to Multnomah County Deputy District Attorney Richard Freud, Mohamed entered Ira's Deli at 7215 N.E. Prescott St. on the morning of July 14 and asked to buy a cigarette.
Shaheen Brodle, who was working behind the counter, told the teen that the deli didn't sell cigarettes individually and that he'd have to buy a pack if he wanted any cigarettes, Freud wrote.
Mohamed demanded to speak to the owner, identified in the warrant as Iraj Rafai. Rafai came to talk to Mohamed and reiterated what Brodle had told Mohamed, the affidavit said.
That's when Mohamed started shouting threats laced with profanity and demeaning comments about Jews and Israel, Freud wrote.
According to the affidavit, Mohamed screamed, "I will blow up your store'' and "I'm going to send my guys to shoot up your store.'' Mohamed also referred to the owner as a "Jew'' and an "Israeli.''
"You Israeli ... I'll blow up your store in the name of Allah!'' Mohamed is accused of yelling, Freud wrote in the affidavit. "We take care of people like you.''
[. . .]
Mohamed is accused of calling the store and leaving another derogatory message, the affidavit said.
Police identified Mohamed after viewing video surveillance images from the deli, the affidavit said.
Mohamed is also accused of cocaine possession in an unrelated case, according to court records.
According to court records, Mohamed came to the United States in 2000.

Democratic Oregon Voters Repeal Law Giving Drivers Licenses To Illegal Immigrants

[From article]
Even as Oregon voters were legalizing recreational marijuana and expanding Democratic majorities in state government, they decided by a margin of 66-34 to cancel a new state law that would have provided driver's licenses to people who are in the United States illegally.
[. . .]
The state law had seemed to be popular. It easily passed last year with bipartisan support in the Democratic-controlled Legislature and was signed Democratic Gov. John Kitzhaber, who was re-elected Nov. 4.
Opponents barely gathered enough signatures to put the repeal question on the ballot. Immigrant rights groups outspent their opponents 10-1.

GMO Labeling on Colorado and Oregon Ballots

[From article]
Oregon and Colorado on Nov. 4 will decide the fate of labeling laws for genetically modified organisms, or GMOs, the latest fronts in a battle over packaging. Measure 92 in Oregon and Proposition 105 in Colorado call for labeling food so that purchasers know whether they are buying products that contain materials that have been genetically engineered or modified.
The states could become the first to pass such a referendum; Washington and California rejected similar measures after expensive campaigns in 2013 and 2012, respectively. Vermont approved such labeling through the legislative process, but the issue is still being fought in the courts.
[. . .]
In Colorado, the supporters of the labeling campaign are heavily outweighed by their opponents: $700,000 to an estimated $12 million, Cooper said.
“It’s definitely a David-versus-Goliath thing,” Cooper said, adding he was proud of the grass-roots support his side had marshaled.
[. . .]
In Oregon, the battle has become the costliest over a ballot measure in the state’s history.
As of the weekend, the two sides have raised $16.7 million, the Portland Tribune reported.
Monsanto has donated more than $4 million to defeat Measure 92, it was reported.

Thrice Married Fiance of OR Governor Married Another Man for Immigration Card

[From article]
Hayes married Abraham B. Abraham in July 1997, when he was 18 and she was 29, she said in an emailed statement Thursday afternoon. They were introduced by mutual acquaintances, met only a handful of times and never lived together, she wrote.
"It was a marriage of convenience," Hayes wrote. "He needed help, and I needed financial support."
Hayes, whose engagement to Gov. John Kitzhaber this summer followed their own 10-year relationship, wrote that she was paid about $5,000, enough to buy a laptop and pay for school expenses. In an emotional press conference at 4 p.m. Thursday, Hayes added that she did not declare the income in her taxes.
[. . .]
I was struggling to put myself through college and was offered money in exchange for marrying a young person who had a chance to get a college degree himself if he were able to remain in the United States."
Hayes has said she was on her own at 16, couch-surfing and struggling to finish high school after her parents fell into a tangle of mental illness and alcoholism. Growing up in rural western Washington, Hayes earned academic and athletic scholarships to Evergreen, where she earned both a bachelor's and a master's degree.
[. . .]
Washington court records show that Hayes filed for divorce from Abraham B. Abraham in a King County court on Oct. 26, 2001. Abraham turned 23 that month; Hayes was 34.
Hayes court records show two previous divorces – from Todd Hayes on March 28, 1989 and from Doug McCarthy on Dec. 17, 1996.
She said Thursday that she has not had any contact with Abraham since their divorce was finalized in February 2002. Not long after the divorce, Abraham went on to graduate magna cum laude with a degree in mathematics from Greensboro College in North Carolina. He currently owns a two-story home in a suburb of Washington, D.C.

Remains Of 5,000 Mental Hospital Patients Identified

[From article]
Between 1913 and 1971, more than 5,300 people were cremated at the hospital.
Most were patients at the mental institution, but some died at local hospitals, the state tuberculosis hospital, a state penitentiary or the Fairview Training Center, where people with developmental disabilities were institutionalized.
Hospital officials have been working for years to reunite the remains of their former patients with surviving relatives. Since the urns were found by lawmakers on a tour of the hospital in 2005, 183 have been claimed.
The 3,409 that remain and have been identified are listed in a searchable online database. Thirty-eight urns will likely never be identified; they're unmarked, have duplicate numbers or aren't listed in ledgers of people cremated at the hospital.

Response of ACLU Oregon To Victims Of Criminal Abuses

John Finch
tijohnfinch (at) gmail.com

Dear Mr Finch

Thank you for contacting the American Civil Liberties Union of Oregon.
As you may know, the ACLU of Oregon is a small, private, non-profit
organization funded entirely by private donations. Typically, the
cases we accept are handled by lawyers in private practice who donate
their time. As a result, we offer legal assistance in only a small
number of cases each year.

Consequently, we must choose cases that most clearly invoke
significant civil rights and civil liberties issues. We focus on
protecting the rights of individuals to be free from excessive
government intrusion and the right to receive equal protection under
the law. These liberties include the rights of freedom of speech,
press and religion, the right to be treated equally and without
discrimination on the basis of race and sex, and the right to be free
of abusive police conduct. Among these cases, we are forced to limit
our representation to “impact cases” i.e., those that present new
legal issues or affect large numbers of people.

We cannot assist in cases that depend on establishing facts. We are
generally unable to get involved in disputes between private parties,
with private employers, or private organizations. We also cannot
intervene in a situation where an attorney has already been retained
unless the attorney personally requests assistance, and even then, all
the other criteria are still in place.

Based on the above criteria, we have concluded the ACLU is unable to
provide you assistance. Please be assured, however, that this does not
reflect on the worthiness of your case.

I have enclosed the ACLU of Oregon’s Referral and Information sheet.
One of the organizations listed may be able to assist you. I regret we
are unable to help you further.

Sincerely
(signature)
