After Six Year Delay, Special Prosecutor Appointed, Guards At Psychiatric Hospital Indicted For Homicide of Patient

Josh Messler, 23, Died In Custody, After Brutal Guard Attack in Hospital

[From article]
Lisa Brown says there is finally justice for her late son Joshua Messier who was only 23 years old when he died while being restrained by guards at Bridgewater State Hospital six years ago.
Now three of those guards have been indicted, charged with manslaughter and civil rights violations.
“I’m thankful to God that finally, finally when it seemed like there wasn’t going to be any justice that there’s a first step,” said Lisa Brown.
Josh Messier suffered from schizophrenia. He was sent to Bridgewater State Hospital after staffers at a private hospital filed assault and battery charges.
A month later, the incident at Bridgewater was captured on video. Following his restraint, Messier died of heart failure.
“They piled on top of him. They pushed into his back. Apparently they folded him in half so he couldn’t breath,” Brown said.
Plymouth County District Attorney Tim Cruz declined to press charges after what he called an exhaustive investigation.
But last year, Attorney General Martha Coakley reopened the case appointing a special prosecutor who decided to seek charges. Attorney Roderick MacLeish represented Joshua’s mother.

Government Control Freaks Take Freedom From Advocate for Persons With Disabilities, They Discredit Her and Diminish Her Spirit

Left: Alison Hymes attends a friend's wedding in Washington in 1984. (Courtesy of Alison Hymes) Right: Hymes is seen at the entrance of Riverdale Assisted Living on Dec. 17, 2014. (Evelyn Hockstein/For The Washington Post)
Contrary to its image of love and compassion, psychiatry is a means of social control with no due process protections. Among the misguided standards is if a person denies the entire concept of mental illness that too is a mental illness. Human emotions, ordinary protected speech and behavior are classified as illnesses. Using arbitrary standards psychiatrists take a person's freedom for speech and behavior which they do not like or do not understand.

[From article]
Hymes was no ordinary patient. Before landing at Western, she spent years urging others with mental illness and their families not to let doctors, judges and social workers make decisions for them. She was part of a state task force charged with reforming civil commitment laws at the time of the 2007 Virginia Tech massacre, serving alongside doctors, academics, and law enforcement officials.
The daughter of a prominent University of Virginia linguist, Hymes argued vehemently — and unsuccessfully — against loosening the state’s commitment criteria.
[. . .]
Anyone who knew Hymes from her days on the state’s commitment task force would not have recognized the timid woman in the hospital waiting room.
She had been a fixture at public meetings on mental health issues for years, with a reputation for challenging anyone, no matter how important.
[. . .]
Author Pete Earley, who served with Hymes on the state panel, described her as the loudest, fiercest voice against involuntary hospitalization and forced medication. “She wouldn’t give an inch and celebrated being an outsider,” he said. “She was relentless if you disagreed with her.”
[. . .]
Years of taking lithium had ruined Hymes’s kidneys. She was on a transplant waiting list as she served on the task force, spending much of her free time going to dialysis.
[. . .]
More significant for Hymes, the state adopted the approach to involuntary hospitalization recommended by the task force. It no longer required that people pose an “imminent danger” to themselves or others before they could be committed, but it also allowed involuntary hospitalization of those who showed a “substantial likelihood” of harm because of an inability to protect themselves from harm or to provide for their basic human needs.
[. . .]
When asked whether she was mentally ill, she replied, “I don’t really believe in mental disability.”
To clinicians, her answer was a sign of her illness, and they sent her to Western for what became a one-year stay. To her friends in what’s called “the psychiatric survivors movement,” her statement was a sign of sanity. She shared their view of involuntary hospitalization, forced medication and the use of restraints as traumatizing and a violation of civil rights. To them, she was not a patient but a political prisoner.
[. . .]
When outside pressure against her hospital commitment did not work, Hymes grew dejected. A doctor described her as “feeling hopeless and helpless” and saying, “ ‘I give up.’ ”

Psychiatric Propaganda

Underlying Torrey's arguments is the false premise that mental illness causes crime. There is no causal connection between made up illnesses with no pathology and crime. The decision where to incarcerate persons charged with crime and/or convicted is with the judge. It should not be in the hands of psychiatrists who remain clueless about due process protections and individual rights. Psychiatry is a means of social control with no due process protections, personal opinion masquerading as science. Psychiatrists believe their genes have been cleansed of mendacity, greed and sadism. They claim omniscience and moral superiority. Emotions, protected speech and behavior becomes mental illness requiring loss of freedom. Torrey is especially offensive advocating forced drug treatment. He says mental illness causes homelessness. More likely homelessness causes eccentric speech and behavior. Besides Torrey's propaganda promoting taxpayer funded forced drug treatment, when will psychiatric critics be given space to counter this propaganda, e.g., Peter Breggin, Fred Baughman, Robert Whitaker.

[From article]
Police had arrested him 14 months earlier for cutting down three wooden power poles with a chainsaw, terminating power to 6,800 homes in suburban Buffalo in the dead of winter. Like most individuals with chronic paranoid schizophrenia, he doubtless had a logical (in his mind) reason for his actions: perhaps his voices told him that cutting off power would prevent a tsunami from Lake Erie from sweeping over Buffalo.
[. . .]
He mostly refused medication. After all, he thought he was fine.
[. . .]
Yet he would not have been in jail at all if his schizophrenia had received appropriate treatment. Tragically, his family’s efforts to get him medical help ran up against New York’s laws, which make the involuntary commitment of adults exceedingly difficult.
[. . .]
Once a leader in public psychiatric services, New York State now shows how not to treat the mentally ill.

Suspect Held in DC Psychiatric Hospital for 40 Years After Arrest For Theft of $20 Necklace

Franklin Frye, 68, has been in D.C.'s St. Elizabeth's psychiatric hospital since being charged with stealing a $20 necklace in 1970.
Photo by Jim McElhatton/The Washington Times

The problem lies with psychiatry and their priests.

[From article]
It didn’t matter. Four decades ago, police charged him with stealing a $20 necklace, but Mr. Frye was found not competent to stand trial. If he’d been found guilty, he would’ve faced a fine or perhaps a short jail sentence. Instead, he’s spent most of his life inside the District’s psychiatric hospital, St. Elizabeth’s, feeling frustrated with, and forgotten by, the very system charged with looking after his welfare.
It’s a case that raises tricky questions about fairness within the criminal justice system and life inside St. Elizabeth’s. Indeed, for years the court system simply lost track of him.
[. . .]
Through the D.C. public defender’s office, Mr. Frye sought unconditional release in 2008, but his motion was filed on the docket of a dead judge, where it remained until earlier this year — with no apology or explanation from court officials.
[. . .]
But in 1983, the Supreme Court, in the case Jones v. U.S., ruled in a 5-4 decision that there was “no necessary correlation” between the length of a “hypothetical” criminal sentence and how long it takes to recover from insanity.
[. . .]
William Frye said he only recently learned that his brother attends Alcoholics Anonymous meetings, even though he said Franklin has never had a drinking problem.

Remains Of 5,000 Mental Hospital Patients Identified

[From article]
Between 1913 and 1971, more than 5,300 people were cremated at the hospital.
Most were patients at the mental institution, but some died at local hospitals, the state tuberculosis hospital, a state penitentiary or the Fairview Training Center, where people with developmental disabilities were institutionalized.
Hospital officials have been working for years to reunite the remains of their former patients with surviving relatives. Since the urns were found by lawmakers on a tour of the hospital in 2005, 183 have been claimed.
The 3,409 that remain and have been identified are listed in a searchable online database. Thirty-eight urns will likely never be identified; they're unmarked, have duplicate numbers or aren't listed in ledgers of people cremated at the hospital.

Chaos in Mental Hospital Where Murder Suspect Transferred After Attack on Woman Staffer

This is what happens when government medicalizes social problems. Making crimes into mental illnesses rips apart any rational approach to securing criminals.

[From article]
A state-run hospital in Worcester granted day passes to mentally unstable criminal suspects and allowed an accused serial sex predator — under a court order to be held behind bars as a danger to the community — to leave the facility without telling the court, a top prosecutor has charged.
Essex Assistant District Attorney Kate MacDougall leveled the accusations in an affidavit unsealed yesterday asking the court to impose strict conditions on accused Danvers teen killer Philip Chism while he remains at the Worcester Recovery Center and Hospital. Chism is awaiting trial for the rape and murder of his Danvers High math teacher, Colleen Ritzer.
“The commonwealth has serious concerns regarding the safety of staff, patients and the public while the defendant is housed at the Worcester State Hospital,” MacDougall wrote.

Cambridge City Council Wants More Taxpayer Funded Psychiatry

Posted May 8, 2014 9:17 PM ET; Last updated May 10, 2014 12:10 AM ET

On the day after I submitted this letter to the local weakly newspaper, and sent copies to local activists, a thoughtful black racist man employed by the City of Cambridge, took time from his busy schedule to  appear at my residence to conduct surveillance and harassment. He joined the diligent omniscient lesbian graduate student in psychology at Harvard University Medical School who is the primary criminal who harasses me every day. She, another sacred victim, vigorously disturbs my sleep every one or two hours every day, and tampers with my computer. Her black racist male partner in criminal abuse, later showed his dedication to the cause of free expression, by silencing critics, by following me to a concert at a local college, where he used young women as bait for more harassment and character assassination.

Censorship is what black racists do in the City of Cambridge to white men. Black persons are "victims" and can do whatever they want to white people. No less than the Attorney General of the United States, Eric "White people are cowards." Holder and his boss, Barack "Typical White Person" Obama refuse to enforce civil rights laws in a race neutral manner. (See, e.g., J. Christian Adams' book, Injustice; and John Fund and Hans von Spakovsky's book, Who's Counting?) That policy extends down to the city of Cambridge where black racists are free to abuse white people without concern for being held accountable. Even if that is a felony violation of the Massachusetts Civil Rights statute M.G.L. Chapter 265 Sec. 37, intimidation of a person in the free exercise of a constitutionally protected right; and Title 42 US Code 1983 Deprivation of Civil Rights; and Title 42 US Code Section 1985, Conspiracy To Interfere With Civil Rights.

In Cambridge the majority of city and Harvard University officials insist that black people cannot be racists. The Holder-Obama doctrine states that inconvenient laws may be ignored. In Cambridge laws are optional for city and Harvard University officials. Here is only the latest abuse of power by privileged officials. I have no evidence it was either of the City Councilors mentioned in this letter. More likely it was one of the random black racist city employees who love to harass white people. It comes with the territory.

[From article]
"These patients will be seeing these nurses who might not be trained to see people with these conditions," said Councilor Marc McGovern. "I wonder if a hospital would take a cardiology unit and tell patients to just see a podiatrist because ‘they’re all doctors.’"
"If you’ve never had to use the ward, consider yourself lucky, but if you have had to use it you should also consider yourself lucky. It’s a pretty remarkable place," Simmons said. "For me, it is important to stabilize an individual and to have all the resources available at once. This is a closing of the emergency room, and now we will have fragile individuals with people who do not know what is going on. I think it’s a huge, huge mistake."

Councilor Marc McGovern says, "These patients will be seeing these nurses who might not be trained to see people with these conditions[.]" If that's true why do ordinary medical doctors prescribe psychiatric drugs to children and adults if they are not trained? The human services industrial complex (MA State Rep. Marie Parente's term) argues that psychiatric illnesses are no different than physical illness. Why then do they need a special emergency room? Do all physical illnesses need their own emergency room too?  Speaking as an experienced psychiatrist Councilor Simmons says, "For me, it is important to stabilize an individual and to have all the resources available at once. [. . .] and now we will have fragile individuals with people who do not know what is going on." Gasp! Does Councilor Simmons know what's going on? Does she speak for the doctors and the patients? Patients have rights? In Cambridge?

Morocco Psychiatric Hospitals Said to Be Worse Than U.S.

[From article]
Bouya Omar's followers claim the mentally ill are healed by the saint's supernatural powers, but rights groups allege gross mistreatment of those taken there, with one former inmate describing months of "hell".
Activists say hundreds of people have been kept in chains here, sometimes starved and beaten, making the place a byword for cruelty and highlighting the stigma attached to mental illness in Morocco.
[. . .]
The US-trained doctor describes the practises at Bouya Omar as a "crime against humanity," lamenting the "extremely negative attitude towards mental illness" in Morocco, which he mainly attributes to poor eduction.
"The level of awareness in the general population is so low that a lot of people tend to interpret their syndromes, their delusions and anxieties, as a curse, as something that has nothing to do with medicine.

And how are U.S. psychiatric hospitals not a crime against humanity?

Thousands Of Bodies Found On Grounds of Former Mississippi Mental Hospital

[From article]
Officials now believe there may be as many as 2,000 century-old graves underneath the soil.
Archaeologists have been studying grave sites discovered on the UMC campus for some time; several dozen grave sites were discovered last year.
[. . .]
'The property that the University of Mississippi Medical Center is located on used to be the location of the state insane asylum, which operated from 1855 to 1935,' Mazurak said.
'Historically we knew that there were a lot of graves, many of which were not marked. In the '90s, we took the handful of marked graves and reinterred them in a designated cemetery area,' he said.
[. . .]
'We're guessing because there's no personal remains, no clothes, not even really any buttons or pins or anything, that they were probably residents of the asylum and either buried in a shroud or not buried with anything, so that would put them probably around in the mid to late 1800s to early 1900s,' said Anderson.
[. . .]
Moving the bodies would reportedly cost about $3 million so the University has said it will probably look at alternate sites for construction, rather than try to relocate the graves.
The expansion will most likely be relocated to another location on the 164-acre campus.
It's possible there could be more unmarked graves belonging to tuberculosis patients, former slaves, or possibly even Civil War dead, according to the Clarion-Ledger.
The State Lunatic Asylum opened on the site in 1855, housing 150 patients.
After the end of the Civil War, it expanded to house more than 300 residents in a district known as Asylum Hill.

What lies beneath? Gruesome find as workers discover more than 1,000 corpses at site of old Mississippi mental asylum
University of Mississippi Medical Center had planned to build a parking garage east of the dental school
Testing in the area revealed 1,000 bodies, believed to have been patients at the Mississippi State Lunatic Asylum a century ago
Future expansion plans might be halted because other bodies may lie beneath the earth including former slaves, TB victims and possibly even Civil War dead
Staff have always known there was a cemetery associated with the old asylum somewhere on the property, but no one knew for sure where it was until now

VT Woman Held In Psychiatric Hospital After Husband, Son Found Dead

[From article]
A Vermont woman committed to a psychiatric ward against her will after her estranged husband killed their son and then hanged himself was ordered released by a judge Friday.
Christina Schumacher, 48, was ordered released immediately from Fletcher Allen Health Care in Burlington by Vermont Superior Court Judge Kevin Griffin.
Schumacher had been at the hospital since December 19, a day after 14-year-old Gunnar ‘sonny’ Schumacher and 49-year-old Ludwig Schumacher were found dead in an Essex apartment.
[. . .]
Schumacher told the newspaper that she and her insurance company had been billed for the unwanted treatment.
Mike Noble, a spokesman for the hospital, said that he can't speak to the specifics of the case but ‘that in all matters such as this we make decisions that we think are in the best interests of the patient.’

60 Minutes did a propaganda feature about the lack of hospital beds for psychiatric patients. Maybe here's why. People with good insurance policies who do not need treatment are forced into the hospitals for economic reasons.

Man Held in Mental Hospital For 40 Years For Theft of $20 Necklace

Fire At Russian Psychiatric Hospital Kills 37

Russian Emergency Ministry via AP
Emergency crews and firefighters work at the site of a fire at a psychiatric hospital in Luka, Russia, early Friday.

[From article]
Emergency officials had demanded the facility be closed after it failed a fire safety check earlier this year. The hospital administration, however, won permission to continue using it until next year.
[. . .]
Russia has a poor fire safety record with about 12,000 fire deaths reported in 2012. By comparison, the U.S., with a population roughly double Russia's, recorded around 3,000 fire deaths in 2011.
A fire at a psychiatric hospital near Moscow killed 38 people in April.

MN Man Kills Mother, Gets Out of Mental Hospital, Purchases 15 Weapons

Here is one more example of the misguided priorities of the limousine liberals in Massachusetts. This charming young man killed his mother. After being released from a mental hospital he purchased 15 weapons. No one was watching him. No crime families, no police, no FBI informants, no paranoid feminists, no paranoid black racists, no hateful hostile homosexuals. But in the politician's mercenary republic of Massachusetts, in small minded intolerant Cambridge, in the elitist academic enclave host city of Harvard University, MIT and Lesley University,  these charming misguided criminal control freaks attack a 70-year-old white male for imaginary wrongs. They respond like Pavlov's dogs to FBI character assassination broadcast for 42 years beginning when I was student in law school. All of these years to cover up theft, abuse of police powers, criminal human experiments, political skullduggery and more abominations by these groups. They target me and blame me for what they did. This is after the FBI used me to fight organized crime for 15 years and did not pay me one cent. You can't resist loving the useful idiots who run Cambridge, Harvard University and the state government of Massachusetts. They are an unending source of humor if you can stand their depravity and mendacity.

A young man who was convicted of shooting his mother to death as a teen and sent to a mental hospital for years was still able to buy 15 guns once he was released.
Chris Oberender was convicted of killing his mother in 1995 when he was 14-years-old, and he was sentenced to a mental hospital until he was 21-years-old.
Now he is awaiting jail in Minnesota for buying illegal firearms since he is banned from owning guns because he is a convicted felon.

Psychiatrists Lose Their Brains

Great to know that Harvard University researchers continue a tradition practiced by Nazi doctors, saving brains. How little the world has changed. The ruling classes of a fascist regime and a prominent University in an alleged democracy save human brains to study them. Is this for ethics studies or for control? The brains were damaged at a psychiatric hospital according to this report. How does this differ from what usually happens at these institutions, damaging brains in the name of healing?
