An Alabama lawmaker Tuesdayfiled articles of impeachment against the state's governor over what he called "incompetency" and an inability to lead after questions about his relationship with a former staffer.
"We’ve never done this before," said Rep. Ed Henry, a Republican from Hartselle, Ala. "We’ve never tried to impeach a governor." But he added the "process begins today."
Gov. Robert Bentley, also a Republican, in a statement called the move "political grandstanding" meant to distract the state from pressing issues.
"There are no grounds for impeachment, and I will vigorously defend myself and my administration from this political attack," according to Bentley's statement.
On March 23, former Secretary Spencer Collier of the Alabama Law Enforcement Agency accused Bentley of having an affair with his senior political adviser, Rebekah Caldwell Mason. Collier said he discovered the affair in 2014 when Bentley was married to his wife, Dianne.
The Bentleys divorced in the fall, ending their 50-year marriage. Audio of Bentley making suggestive comments in a phone conversation since has surfaced.

Alabama's Constitution allows for impeachment of constitutional officers for a broad range of actions, not all of them illegal. The state's governing document allows for the removal of officers for "willful neglect of duty, corruption in office, incompetency, or intemperance in the use of intoxicating liquors or narcotics ... as unfits the officer for the discharge of such duties, or for any offense involving moral turpitude."

The state Constitution is less specific about the process of impeachment. Unlike theU.S. Constitution, the state constitution does not provide a margin for conviction of an impeached constitutional officer in the Senate. Rep. Mac McCutcheon, a Republican from Huntsville, Ala., said Tuesday the House would set up an investigatory committee to determine if any grounds for impeachment were apparent.

A former top Cuomo aide who is under criminal investigation for “consulting’’ with companies doing business with the state told potential clients he had the administration’s OK for the work — despite never receiving it, The Post has been told.
Madison Square Garden Executive Vice President Joseph Percoco, who until last January was Gov. Cuomo’s executive deputy secretary and one of his closest friends, “told various clients or potential clients that he had approval from the governor’s counsel’s office to work for them,’’ said a source close to the situation.
“It turned out the counsel’s office did no such thing. It didn’t give any approval,” the source said. “And Joe never gave the clients anything to prove what he said, so the clients didn’t get anything in writing.’’
Public records show that Percoco, who left the state payroll for several months in early 2014 to run Cuomo’s re-election campaign, said he received as much as $125,000 in still-unexplained “consulting’’ fees during that year from two companies, COR Development of Syracuse and Albany-based CHA Consulting, which have longstanding dealings and tens of millions of dollars in contracts with the state.
Percoco’s income from the companies didn’t become public until late last month, when US Attorney Preet Bharara served a subpoena on Cuomo’s office seeking records relating to Percoco’s work, as well as the work performed for those and other companies by influential lobbyist Todd Howe, a Percoco friend and longtime associate of both Andrew and former Gov. Mario Cuomo.
Howe, who sources said helped arrange the consulting work for Percoco, was fired last week by a longtime employer — Albany-based law/lobbying firm Whiteman, Osterman & Hanna — after being barred days earlier by Cuomo from having any contact with the state government.

The subpoena, excerpts of which were obtained by The Post, sought “phone logs, visitor logs, calendar entries between January 2012 and present that show meetings with any’’ entities on a list of 26 individuals and companies.
The subpoena also demanded information on “any actions taken by” Percoco, Secretary to the Governor William Mulrow, state Operations Director James Malatras, Buffalo-area Democratic operative Peter Cutler and other Cuomo aides related to the companies for which Percoco and Howe worked, as well as for several other companies connected to the governor’s high-profile “Buffalo Billion’’ economic-development efforts.
It also seeks “any documents concerning’’ two not-for-profit economic-development companies set up in conjunction with SUNY Polytechnic Institute’s Colleges of Nanoscale Science and Engineering and its president, Dr. Alain Kaloyeros, a key “Buffalo Billion’’ adviser.
Sources in the Cuomo administration said the governor appears “increasingly nervous and anxious’’ about Bharara’s probe, and some noted that Cuomo has almost completely disappeared from public view during the past weeks as the scandal began to unfold

New York Governor Cuomo Resells World Series Tickets To Fund Campaign

As The Post reported Tuesday, Gov. Cuomo is using the Mets’ home games in the World Series to raise himself some campaign cash.
His staff picked up a “very limited number” of tickets to this week’s Games 3 and 4 at Citi Field — and is selling the $125 tickets to supporters for as much as $5,500.
The campaign’s offer also includes a ­90-minute private reception with the gov. Cuomo’s not the only pol using the Fall Classic to raise campaign funds: Rep. Grace Meng has a similar scheme — for an only slightly more affordable $2,500 a head.
Now, scalping is perfectly legal in New York; a whole secondary market exists for that purpose. But Cuomo’s charging a major markup: The average Series ticket at Citifield is going for about $1,600 on StubHub.



Worse is the unseemly air of insider access here. It’s far easier for a high-ranking official (or his flunkies) to score seats than it is for the average Joe. Did Cuomo forget the anger when Gov. David Paterson scored Yankees tickets?
And to then milk the prized passes for campaign cash . . .
It’s particularly tacky when Attorney General Andrew Cuomo was so tough on scalpers. Back in 2010, he went after folks who sat in line for free Shakespeare In The Park tickets, then resold them on Craigslist.

So now we have another dead child that his incompetent hacks couldn’t keep track of, that one of his “embattled” agencies proved utterly incapable of protecting.
You know what Deval would say, with a shrug. Just another “anecdote.” If you asked him today — if you could even find him, that is — he might not even recognize the name of Bella Bond. Hey, he never bothered to learn the name of Matthew Denice, run over and killed in Milford by one of Deval’s drunken dreamers as he drove around unlicensed with his anchor baby beside him in the cab of a truck.
Ben LaGuer, that’s a name Deval could recall. He even contributed $5,000 to the convicted rapist’s legal defense fund. Deval swooned over the Tsarnaevs — they were just some “young fellas.” He went on statewide TV to order taxpaying Americans not to call the foreign Muslim welfare terrorists foreign Muslim welfare terrorists.
Everything Deval has ever touched has turned to you-know-what — and that includes the commonwealth of Massachusetts. His 2006 bumper stickers described him as an uncommon leader, and he was. Uncommonly bad.

Carey W. Gabay ’94, a former president of Harvard's Undergraduate Council, died last Wednesday, after he was caught in the crossfire of a shooting in New York City the previous week. He was 43.
Gabay was attending a celebration before the West Indian American Day Parade in Brooklyn, N.Y., when the shooting began, according to The New York Times. He was declared brain-dead last Tuesday night and taken off a respirator.
Gabay’s classmates and co-representatives on the UC remember him as a dedicated and committed leader. Gabay’s devotion to public service did not end after his graduation—at the time of his death, Gabay worked as an administrative lawyer and aide to New York Gov. Andrew Cuomo. He graduated from the College and also attended Harvard Law School.
During his time at Harvard, Gabay served as UC president at one of the most diverse periods the Council had seen. When Gabay took office, he did so as one of the Council's first top African-American leaders.

After more than a dozen credit-rating downgrades in five years, Illinois has the lowest rating among the states. Unfunded public employees' pension liabilities are estimated, perhaps conservatively, at $111 billion, the nation's largest such deficit as a percentage of state revenue. Currently, public pensions consume nearly 25 percent of general state revenues. The state owes vendors $6.4 billion in unpaid bills, and more than 1 million people have left Illinois for less dysfunctional states in the last 15 years. Debt per resident is about $24,989, compared with $7,094 in neighboring Indiana.

Four of the previous nine governors went to prison, so, Rauner says, "people know we've had bad people in charge." Bad but routine practices are astonishing.

Rauner says previous governors from both parties have been complicit in the unionization of about 93 percent of government employees.

“Invest in the future.” In New York, Governor Andrew Cuomo follows in a long line of political leaders who, using some version of those words, said that they wanted to invest in jobs and growth—and then did little to follow through. If Cuomo and others really wanted to make such investments, they would have reduced taxes, both for individuals and businesses, and streamlined regulation.

For decades, New York has been one of the highest-tax states in the union.

Governor Cuomo’s “Global NY” initiative, targeting Mexican, Canadian, Israeli, Chinese, and Italian firms, while also paying for the governor to lead a trade mission to Cuba, does not appear to have lured any significant business to the Empire State.

Failure to invest in policies that actually grow the economy, then, demonstrates that the constant talk of investment is pure rhetoric.
More telling still is where the budgetary emphasis has gone. Without exception, spending has grown fastest in areas best described as current consumption.

Calling it a salute to the “genius” of the country’s founding fathers, Gov. Greg Abbott on Saturday signed legislation allowing Texans with licenses to openly tote their handguns in a hip or shoulder holster.
The signing of the open-carry bill, House Bill 910 by state Rep. Larry Phillips, R-Sherman, came at Red’s Indoor Range, a popular gun store and shooting range in Pflugerville. Abbott said he would also sign legislation later in the day that requires the state’s public universities and colleges to allow handguns on campus buildings and in dorms.
“There is nothing more important in democracy than the voice of the people stepping up and saying ‘We expect the Constitution of the United States of America to be our guiding doctrine,’” he said.

The bill, passed by the state Legislature and expected to earn Gov. Greg Abbott’s signature within the next week, would reverse a 140-year-old ban on carrying handguns in plain sight. Despite its reputation as a pro-gun state, Texas is one of just five with an outright ban on open carry.
“It’s a thumbs up for law-abiding citizens,” said Rep. Debbie Riddle. Riddle, a Republican who represents part of Houston and co-sponsored the bill. “Everywhere there is a denial of Second Amendment rights, crime is through the roof. It’s a deterrent. The saddest part of this interview is how great the differences are between Mario Cuomo and his sons. They appear to be clueless about the Constitution and how it applies to the freedoms of Americans. One son, Andrew is the Governor of New York State. The US Attorney keeps getting closer and closer to this governor with his investigations into corruption. Chris Cuomo seen in this clip shows the same apparent ignorance of the meaning of constitutional rights. Not only is this Cuomo son a member of the "but brigade,","I support the First Amendment, but . . . " but he is also an opponent of the second Amendment.

Cuomo and Pamela Geller got into shouting match over that analogy. Cuomo went on to opine that the other real problem with the event, in addition to its immorality, was that there is not enough gun control, because a Marine had advised people to bring their guns.
Mr. Cuomo forgot that it was a citizen bearing a legal gun who prevented a massacre in Geller's draw Mohammed contest just a few weeks ago!
Cuomo thinks it is immoral, in itself, to use free speech that offends a differing opinion. But most astonishing was his assertion that "[t]he First and Second Amendments weren't put together to defend each other, that's for sure." Does Cuomo really not see the significance of the sequence of these amendments – the enumeration of rights followed by the right to bear arms to protect them? Can he really believe that the First and Second Amendments are not related?

Instead, he issued a page-long statement that was released Friday that made clear his pain and frustration with having to abandon what was to be a historic fourth term. Yet, he wrote, he understood why the move was necessary.
Criticism had mounted in recent weeks over how Kitzhaber had handed Hayes' roles as an unpaid clean energy and economic policy adviser in his office, and as a consultant paid to promote the same topics. Since Kitzhaber took office in 2011, Hayes had collected at least $213,000 from contracts, records showed.

The very thing that makes voters and taxpayers cynical is accepted by the ruling elite. At a book reading about wholesale corruption of the Boston Field Office of the FBI,  I asked the authors. "Are we are supposed to believe that when (Boston crime boss) James Bulger became a fugitive (for 16 years), all of the gambling  and drug rings operating in the Boston area vaporized, and that all policemen became honest?" They laughed and admitted that the reason Bulger was a problem was that he killed too many people, and corrupted too many police and FBI agents. So as Cuomo suggests, having some corruption is how politicians do business. Bulger's brother William, the Massachusetts State Senate President stated that reformers do not get re-elected. Then there is William Bratton NYC police Commissioner who famously said when Rudolf Giuliani was mayor, "People do not like whistle blowers."

2015 brings a new Governor for Massachusetts. But the bureaucracy lags behind and acts the same as under the previous Governor. Over the past 25 years a group of Harvard University campus police and their employees conducted a brutal campaign of surveillance and harassment. It continues in 2015. Never having had any positive response to previous complaints, I stopped complaining to city and state officials. It was a waste of my time, something encouraged by police over 44 years, wasting my time, that is. They all say, "He's crazy." and ignore my complaints. Legally these depraved police employees are abusing a disabled person, with police protection. It is how the Harvard University campus police thugs and their employees are able to cover up their abuses. "He's crazy." covers it all. Bullies love to prey on vulnerable citizens, especially white male citizens, who are not homosexual.

I live on property owned and operated by the President and Fellows of Harvard College. When I experienced criminal acts, my calls to the Cambridge police dispatchers were diverted to Harvard University campus police, who did not respond to my calls. When I was able to get through to Cambridge police they did respond and took my complaint. But the Harvard University campus police (HUPD) did not stop their abuses.

An undergraduate instructor of mine, who now teaches at Harvard Law School told me many years ago if I had any trouble I should call the Harvard University General Counsel. When I experienced the first act of police abuse I called to the Office of General Counsel. There was no positive response, no response at all. No reduction in the harassment by HUPD.

The enabling Mass General Law statute reveals that HUPD are special state police and have jurisdiction to enforce state laws on the property of Harvard University. I noticed how they act outside of their jurisdiction regularly. When I gathered evidence of health hazards over which the city of Cambridge has jurisdiction and not the HUPD, three HUPD officers stopped me and questioned me. When I explained to them that they were negligently trained they became sarcastic, asking me if I was going to train them. I've written many times about this problem and spoke to the city government and to the police in the city of Cambridge. It is a police problem which the city police enable by ceding jurisdiction to HUPD even when they do not have it.

It is unlikely the Massachusetts Executive Office of Public Safety will change the way that HUPD operates. But I want them to stop harassing me. I am not charged with any crime. I have no notice of any allegations against me. But the HUPD freely harasses me and follows me. The last instance was on Thursday January 29, 2015.



At about 3:30 PM I called to the Massachusetts Executive Office of Public Safety MEOPS. The receptionist referred me to Lisa Morales, said to be an executive assistant. Her telephone greeting names Andrea Cabral as the Secretary of Public Safety. According to the state web pages Thomas G. Gatzunis, is the current Commissioner. I do not know the difference between the Secretary and the Commissioner. But on my last visit to the MEOPS it was explained to me that the MEOPS does not have jurisdiction over local police. But It does have jurisdiction over state police and the special (campus) state police.

Nonetheless Lisa Morales left a voice mail message telling me that the campus police are under the State office of Education. I left a voice mail for her that the state makes the HUPD special state police and thus they are under the MEOPS. The next day she called again stating in a voice mail that she may have someone to refer me to. Aha! The bureaucratic plot thickens.

I know a lot about giving citizens the run around. I've experienced it over many years in large institutions and government agencies.Often it is not intentional, but incompetence. I do not know what it is in this case. I stopped interacting with government as a result of their disinterest in addressing abuses by police. I do not participate in the lawless protests on state highways. I am not a supporter of the "black lives matter" movement which slanders police. But I do object to the abuses of police power for personal and for political purposes which is what the HUPD does regarding me.

I read one book about bureaucracy that explained that the best time to obtain redress and to seek changes is when there is a new administration, e.g., a new governor and his new team. Thus I will send this as a letter to the new commissioner. If there is a response, I will update this post at that time.

The MA Governor shared PR guru David Axelrod with the White House. Both administrations favored spending taxpayer money on PR flacks over solving human problems and helping people. Well, vulnerable people. They had no inhibitions helping wealthy and powerful people. It shows how misguided these politicians are. The most uninformed and greedy people support both politicians. They favor keeping people ignorant and misled so that they cannot understand what they need to do. Jonathan Gruber revealed their attitude toward ordinary voters and taxpayers. As he walks out of the State House today, Gov. Deval Patrick leaves taxpayers not just a big budget deficit and a broken health care website but an army of more than 50 public relations flacks costing millions, according to records obtained by the Herald.
The Patrick administration’s press and communications team is spread throughout the governor’s office, departments and agencies — some so obscure taxpayers may not even recognize them — whose primary job was to make the governor look good.
The PR team under the executive branch, which had been slashed in half by former Gov. Mitt Romney in 2003, has been beefed up again by Patrick during his eight-year tenure, according to payroll and other records reviewed by the Herald.
One of the quasi-public agencies created by Patrick, the Massachusetts Life Sciences Center, has a highly paid marketing and communications chief, Angus McQuilken, a Democrat who lost a state Senate race to Scott Brown 10 years ago. McQuilken is now doing just fine, thank you, earning $144,000 a year to promote Patrick’s life sciences agency.

I came to Boston to host a talk show about the same time he began running for governor. In that eight years he turned down every single request to come on my show and debate his ideas — despite the fact we were often in the same studio together at WTKK.

I think he and his key handler David Axelrod are true believers in “base” politics: get your people to the polls, keep your faction whipped up, and forget the middle, the swing voters, altogether. Gov.-elect Charlie Baker said a federal case in which an illegal immigrant bribed a RMV clerk up to $1,000 to score dozens of Bay State driver’s licenses is “as good an example as any” of the trickle-down effect of the nation’s “broken” immigration policy.
Speaking in an interview on the new “Boston Herald Drive” morning news show on Boston Herald Radio, said he wants to be part of a state and local effort to engage the feds on how to mold immigration protocol, including moving the state into compliance with the federal law known as REAL ID.
He cited a Herald story today detailing how an illegal immigrant is facing charges of bribing a Registry of Motor Vehicles clerk at the agency’s Revere branch for at least 29 driver’s licenses — with the payments ranging anywhere from $100 to $1,000. At least two other illegal immigrants and three RMV officials have been charged as part of an ongoing investigation in recent years, the Herald reported.

Cuomo and The Post were not friends. We mercilessly trashed his policies, and he retaliated in kind. Yet, while the loons battled for control after former owner Peter Kalikow faltered, Cuomo proved himself an honorable man of rare magnanimity.
When Hoffenberg was delivering daily, zany newsroom tirades, Cuomo popped in and promised, “We are looking at alternative forms of investment . . . just in case Mr. Hoffenberg should change his mind” — prompting Hoffenberg to sputter in rage.

The Post’s March 16, 1993, edition carried the famous front page showing founder Alexander Hamilton shedding a tear.
In a visit that day to demoralized Post staff in a diner next door, Cuomo celebrated the paper, “It’s like the World Trade Center towers, if it goes down, that’s bad for all New York.”
Summoning his great oratorical power, he roared, “I like to think The Post is indestructible, and if it survives Abe Hirschfeld, it will be” — and the room went wild.

Cuomo wrote to Rep. John Dingell, who oversaw the FCC: “I frequently disagree with The Post’s editorial stance . . . I anticipate that under . . . Rupert Murdoch, I will continue to find myself at odds . . . nevertheless I respect the value of a vigorous, independent journalism voice, and would join its other readers in bemoaning its passing.”
The FCC granted the waiver.
Maybe it would have happened anyway. But for legend’s sake, and for the heart he gave to us in our darkest hour, Mario Cuomo earned an unlikely hero’s place in The Post’s proud 213-year history.

Cuomo attended P.S. 50 and St. John’s Preparatory School. A gifted student, graduated at the top of his class at St. John’s University Law School in 1956 after earning a bachelor’s degree.

Mario and Matilda, also a St. John’s student at St. John’s who became a school teacher, wed in June, 1954. They have five children: Governor Andrew, Chris, Maria, Margaret and Madeline.

Cuomo first claim to fame came in the late 1960s as a community lawyer representing the “Corona Fighting 69”, a group of property owners fighting a plan to demolish their homes to make way for a new high school. After a six-year battle with the Lindsay administration, Cuomo and the homeowners prevailed in saving most of the homes from the wrecking ball.
Cuomo’s work in Corona caught the eye of then-Mayor John Lindsay, who tapped him to mediate a racially-tense dispute over the city’s plan to build low-income public housing towers in middle class Forest Hills. He fashioned a slimmed down, compromise plan that won the support of the community leaders as well as City Hall, a delicate feat that drew widespread praise and catapulted him into politics.

He called the 2009 arrest of scholar Henry Louis Gates Jr. at the hands of Cambridge police, “every black man’s nightmare,” and used the clash to describe his own brush with what he described as hostile law enforcement officials in Chicago.
Patrick  had waited more than a week before commenting on the Michael Brown killing, but was free with his emotions when he told the Herald on Aug, 20 he was “sick of unarmed black men being shot by police,” adding, “I’m sick of the lawlessness on the streets. I think everyone is just tired of when are we going to get through with this kind of thing.”
But Patrick’s bristling answers yesterday summoned the past — when the governor has clashed with the press.
Most recently, Patrick told Fox 25’s Sharman Sachetti, “Don’t ask me that question,” when she asked him how he felt regarding the decision not to indict Ferguson
police officer Darren Wilson. Wilson shot and killed an unarmed black man Aug. 9.
Patrick went on to easily answer the question while on NBC’s “Meet the Press” and said he “wanted to see an indictment.”
