The Department of Homeland Security on Thursday dismissed an ICE whistleblower it was secretly smearing to reporters after she testified before Congress about her troubles with the agency.
Special Agent Taylor Johnson — who had a storied career until she irked Senate Minority Leader Harry Reid by objecting to a visa program for foreign investors tied to the senator’s son — says she declined to take a $100,000 severance package because it included a non-disclosure agreement.
Gee, what a great use of taxpayer money that would have been. Pay a woman not to talk about what already got nationwide coverage when she talked about it before Congress.
DHS Acting Assistant Secretary for Public Affairs Todd Breasseale did not respond to multiple inquiries about the reason for Johnson’s dismissal and why they tried to buy her silence.
Despite all the media coverage of her case, including a Washington Gadfly report that the ICE press secretary with the approval of Breasseale was peddling confidential information to discredit her in violation of the Privacy Act, Taylor is not surprised she got the boot.
“My entire chain of command was appointed by Obama,” she remarked. “They can do anything they want.”
In testimony last June to the Senate Committee on Homeland Security and Governmental Affairs Johnson said she was stripped of her gun and badge, without explanation, after discovering fraud and abuse.
“Some of the violations investigated surrounding the project included bank and wire fraud, and I discovered ties to organized crime and high-ranking politicians and they received promotions that appeared to facilitate the program,” Johnson testified.
She said that during her investigation in 2013, she “discovered that EB-5 applicants from China, Russia, Pakistan, Malaysia had been approved in as little as 16 days” and that case files “lacked the basic and necessary law enforcement queries.”
At ICE, Johnson had amassed many awards and never had any disciplinary problems. But everything changed abruptly in 2013 when she invoked the ire of Senator Reid by holding up a visas (sic) for a foreigner investor in a Las Vegas casino represented by his son, attorney Cory Reid.
The Senator’s office complained to Johnson’s Special Agent in Charge. She was then placed on administrative leave, without explanation, on October 13, 2013.
Under pressure from Senate Democratic staffers Johnson did not mention in her testimony the role Reid’s office played in her ouster. But the DHS Inspector General concluded in a report last March that U.S. Customs and Immigration Services (USCIS) director Alejandro Mayorkas intervened in “an unprecedented matter” to approve EB-5 visas for the Las Vegas casino investors after pressure from Reid’s office.
The report essentially vindicated complaints by Johnson and other DHS employees about the program.
DHS has never given any public explanation for the disciplinary action it took against Johnson. After the hearing a DHS spokeswoman said they do not talk about personnel matters. But this past December, ICE press secretary Gillian Christensen, citing confidential information from Johnson’s file, tried to convince this reporter off the record that she was a dishonest and a problem employee.
That argument is going to be even harder to peddle now that the Department would have allowed Johnson to leave with a clean work record and $100,000 in spending money if she promised to keep her mouth shut.
Johnson is soliciting donations on gofundme.com to cover legal fees for a possible federal lawsuit.

A former vice president of the Battery Park City Authority has filed a federal whistle-blower lawsuit, claiming he was fired for exposing corruption in the awarding of contracts, The Post has learned.
Kirk Swanson, a former VP and chief contracts officer at the state agency, alleges he “discovered that high-level BPCA employees were making false statements in an effort to bypass the BPCA’s contract approval process.”
Swanson sent a memo to Gov. Andrew Cuomo’s office outlining his accusations in May 2014 — just days after his ouster. The governor appoints the agency’s three-member board.
“It was Mr. Swanson’s job to ensure that the BPCA followed anti-corruption guidelines,” said Swanson’s lawyer, Jason Solotaroff. “It’s outrageous he was terminated for doing just that.”
Swanson alleges that agency president Shari Hyman selected a favored vendor, Revolver Studios, to redesign two online sites without aggressively seeking other bids.
“Work on the Web site projects had begun prior to the contract being approved, again in violation of BPCA procedures,” the suit said.
Swanson said he was told Hyman sought to bypass normal contracting procedures, which would have required three competitive bids. Instead, the agency labeled the contract a “discretionary procurement” and split it into two parts for less than $50,000 each — one for the BPCA and the other for the Battery Park Conservancy, its not-for-profit arm.
Swanson called the outcome “utterly bogus.”
He subsequently found out that agency officials in February 2014 had approved a new contract with a law firm, Liddle & Robinson, to handle $1 billion in bond transactions. But the legal work had not been presented to or approved by the BPCA’s contract selection committee.
The former executive said the contract was approved by his deputy behind his back, when he was on vacation.
Swanson was fired three days after he sent an email to legal counsel questioning the transaction.

High-ranking US customs agents violated a treaty with Mexico by approving a covert drug-smuggling probe that took a disastrous turn — funneling at least $100,000 to Mexican dealers while getting an informant killed, The Post has learned.
An alleged coverup of the busted operation allowed two officials to score plum promotions,

Meanwhile, the Mexican government remains completely in the dark about the affair, the source said.
“It’s an unprecedented rogue operation in a foreign country,” the source said.
“You have so many points at which this activity should have been curtailed, and you just wonder who in leadership is actually watching what’s going on.”
The undercover operation was run out of the ICE office in San Diego, according to an email dossier compiled by a whistle-blower, who sparked the government investigations. The whistle-blower is one of several current and former agents with knowledge of the botched probe.
The ICE agents recruited a Mexican national, Isaias Borquez Lizarraga, 39, as an informant. He pretended to smuggle drugs into the United States so the “proceeds” could be traced back to traffickers in Mexico, a source said.
But the operation was conducted without approval from the Mexican government, a move that violated the 1999 Brownsville-Merida Agreement, which governs American law enforcement activity south of the border, the whistle-blower reported.
Lizarraga’s cover was blown, and he was among three people found shot to death, execution-style, on March 28, 2014, inside a dental lab in the Mexican border town of Los Algodones, just west of Yuma, Ariz.


Even after Lizarraga’s murder, ICE agents in San Diego used another informant to make a series of wire transfers totaling at least $100,000 to Mexican bank accounts controlled by the drug supplier, according to the dossier.
None of that money has been recovered, the whistle-blower wrote.

According to the whistle-blower’s report, Derek Benner, the special agent in charge of the San Diego ICE office at the time, and Nick Annan, who was his deputy, “directed and sanctioned” the operation that resulted in Lizarraga’s death and the loss of the taxpayer cash.[. . .]

Meanwhile, several ICE officials involved in the screw-up got promoted, with Benner transferred to ICE headquarters in Washington, DC, where he now holds the title of deputy executive associate director of Homeland Security Investigations.
That job makes him No. 2 in charge of more than 10,000 employees around the world.[. . .]

Annan was named special agent in charge of ICE’s Homeland Security Investigations office in Atlanta, which oversees operations in three states and is “one of the most productive offices in the country,” according to ICE.

The Department of Homeland Security has estimated that 90 percent of all the cocaine consumed in the United States arrives via Mexico, with traffickers there raking in between $19 billion and $29 billion a year.
The drug trade has been blamed for up to half of Mexico’s 15,000-plus murders last year.

At every stop, he reduced crime while changing the culture of policing. He was on the cover of Time magazine during his first stint in New York, was the subject of a Harvard Business Review study on turnaround leaders and in 2009 was awarded the honorary title of Commander of the Most Excellent Order of the British Empire by Queen Elizabeth.
For all that glory, Bratton, at age 67, now faces the most difficult challenge of his career.
Crime is exploding in New York, but he could handle that. His problem is his boss.

Bill de Blasio was a red-diaper baby and nursed a lifetime affinity for radical causes. From supporting Castro’s Cuba and Nicaragua’s Sandinistas to admiring the Communist mothership, the Soviet Union itself, de Blasio’s “power to the people” fantasy runs to his bones.
His commitment is so horribly rigid that he’s willing to accept scores of innocent New Yorkers getting slaughtered needlessly to prove his point. He will do almost anything in service to his manifesto, which might be summarized as “better dead than not red.”

Bratton, of course, cannot escape his role in this bloody predicament. Driven by ambition to get the New York job again and by personal animosity toward Ray Kelly, Bratton joined candidate de Blasio’s chorus that Kelly’s historic record of low crime was tainted by unprofessional and unconstitutional practices.
His audition was successful, but no sooner had de Blasio given Bratton the job than the mayor started to take away the tools necessary to do it. Stop-and-frisk was mostly banned, community policing became a euphemism for looking the other way and cops were put on notice that City Hall wouldn’t have their backs in a crisis. Al Sharpton, owed a political debt, was put on a policy par with Bratton.
The result was inevitable. When marchers in Manhattan last December chanted, “What do we want? Dead cops,” one era ended and another one was born.

An official at the U.S. Office of Special Counsel said Monday that Department of Veterans Affairs officials are known to be retaliating against VA whistleblowers by illegally going through their medical records, in an apparent attempt to harass and discredit these whistleblowers.
This surprising testimony from Special Counsel Carolyn Lerner was delivered at a House Veterans Affairs subcommittee hearing, which was called to discuss the problems whistleblowers face when they try to expose the ongoing failure of the VA to provide medical care to veterans.

In Lerner’s prepared testimony, she explained that many VA officials who try to reveal these problems are veterans themselves who are also seeking care at the VA. She said in some cases, VA officials try to retaliate by examining the medical records of these officials, and said this still happens — she called it an “ongoing concern.”
“In several cases, the medical records of whistleblowers have been accessed and information in those records has apparently been used to attempt to discredit the whistleblowers,” she said.

The problem of VA officials illegally going into the medical files of their employees is one that has been noted before, but is also one that the VA was supposed to have been on the road to fixing by now. In 2010, the Pittsburgh Tribune-Review reported that a VA official was convinced that her superiors illegally went through her medical records, which led to comments at work about her psychological care.
That report found more than 14,000 privacy violations at the Pittsburgh center.

Lerner of the OSC said complaints of whistleblower retaliation are on the rise. She said her office hears complaints across the federal government, but said 40 percent of them now come from the VA.
“[T]he number of new whistleblower cases from VA employees remains overwhelming,” she said. “These cases include disclosures to OSC of waste, fraud, abuse, and threats to the health and safety of veterans, and also claims of retaliation for reporting such concerns.”

The White House Press Secretary, Josh Earnest, said that it does not take away from the players' accomplishments, because of what the parents and adults did to enable their cheating. That is like saying  that affirmative action does not take away for the accomplishments of politicians, firemen, corporate leaders, celebrities who benefited from affirmative action. Really? So as long as the beneficiaries of cheating and fraud did not act illegally themselves, then it is acceptable for others to do the dirty work.

Chris Janes — the vice president of the Evergreen Park Athletic Association and coach of a team that lost 43-2 to Jackie Robinson in four innings — had emailed Little League International in October to alert officials that he and others thought the all-star squad had been “manipulating, bending and blatantly breaking the rules for the sole purpose of winning at all costs.”

Dave Belisle, the coach who gave a viral inspirational speech to his Rhode Island team after its elimination by Jackie Robinson West, said he laments his team may be remembered for “how they got beat by cheaters.”
Belisle told local news outlets he feels for the Chicago kids and is sickened by the actions of the adults who orchestrated the scheme.

The CIA got hold of the legally protected email and other unspecified communications between whistleblower officials and lawmakers this spring, people familiar with the matter told McClatchy. It’s unclear how the agency obtained the material.
At the time, the CIA was embroiled in a furious behind-the-scenes battle with the Senate Intelligence Committee over the panel’s investigation of the agency’s interrogation program, including accusations that the CIA illegally monitored computers used in the five-year probe. The CIA has denied the charges.
The email controversy points to holes in the intelligence community’s whistleblower protection systems and raises fresh questions about the extent to which intelligence agencies can elude congressional oversight.

So, after a total of seven hours, we took off the restraints. The patient was very appreciative. She was trying to hug us, she was so happy.
But 30 minutes later, the attending physician learned about the release and was furious, demanding that we tie the patient down again. We refused, because there was no justification.
She was not imminently a danger to herself or others. Under VA policy, we’re supposed to place patients in the “least restrictive environment” and use restraints only as a last resort. In a case like this, where a woman had a history of sexual trauma and multiple medical problems, restraints would not help — and could even be harmful. It could bring up memories of her trauma, which could range from rape to sexual assault and leave her very vulnerable.
I learned from my nursing staff that the same female veteran was readmitted in February and was kept in restraints for 49 consecutive hours over Presidents Day weekend.

Last month, they found that a nurse had been diverting morphine. He was withdrawing the drug from vials and replacing it with water or some other unknown substance.
Over the past year, this had occurred more than 5,000 times.
This means our hospice patients were not getting their pain medication. The veterans were dying in pain. [. . .]
I feel betrayed and humiliated the way the VA has tried to silence me, tarnish my career and hide what happened. Since I have come forward, data on the use of restraints, which we are required to keep, has gone missing from the electronic files. I’ve worked really hard for 28 years and don’t want to end my career this way.

Disabled Air Force veteran and veterans advocate/attorney Benjamin Krause has been raising questions about the system for months and warning his peers. Under the VA policy on "patient record flags" (PRFs), federal bureaucrats can classify vets as "threats" based on assessments of their "difficult," "annoying" and "non-compliant" behavior.
The VA manual says the flags "are used to alert Veterans Health Administration medical staff and employees of patients whose behavior and characteristics may pose a threat either to their safety, the safety of other patients, or compromise the delivery of quality health care."

the Disruptive Behavior Committees are secret panels "that decide whether or not to flag veterans without providing due process first. The veteran then has his or her right of access to care restricted without prior notice."

MA Officials Punish Whistle Blowers

Dorien Bazemore, 17, of Roxbury, said, “People are quiet because they’re scared to say something, because they know what’s going to happen.” Why do police and politicians expect teens to share information with police about crimes by their peers, while officials remain silent about crime by their colleagues? Do lawyers cooperate with police about crimes by lawyers? Do doctors report criminal acts by doctors? William Bulger said, "I do not remember." when asked about his brother James who is on trial for 19 homicides. Massachusetts role models set the standards for teen morality. Whenever I write about wrongdoing by city, state or Harvard officials one of their associates bring harassment and threats the next day. Why should teens jeopardize themselves?
