During the Democrat “debate” last night, Hillary Clinton made the astonishing claim that Donald Trump was being used in ISIS recruiting videos. That resulted in a quick bit of “fact checking” by the progressive media which revealed that, no, Donald Trump wasn’t being used in ISIS recruiting videos. My colleague, Joe Cunningham, covered the demolition of that egregious lie.
As it turns out, there is a prominent American featured in an ISIS recruiting video and that person is Bill Clinton.

US Court of Appeals 9th Circuit Improves Fair Use Protections For Online Posting

On Monday, the United States Court of Appeals for the Ninth Circuit, in San Francisco, cleared the way for the case to go to trial, and set a guideline that may change the way media companies police their holdings online. In its decision, the three-judge panel ruled that copyright holders must consider fair use before asking services like YouTube to remove videos that include material they control.

“Today’s ruling sends a strong message that copyright law does not authorize thoughtless censorship of lawful speech,” Corynne McSherry, the foundation’s legal director, said in a statement.
A spokesman for the Recording Industry Association of America, Jonathan Lamy, said, “We respectfully disagree with the court’s conclusion about the D.M.C.A. and the burden the court places upon copyright holders before sending takedown notices,” referring to the 1998 Digital Millennium Copyright Act.
In her suit, Ms. Lenz argued that her use of Prince’s music was protected by fair use, which allows the use of copyrighted material under certain conditions like commentary, criticism or news reporting.

A 74-year-old Alabama mayor has been beaten with a baseball bat by a 71-year-old former radio co-host in supposed retribution for a sex tape he allegedly made with the man's wife, it is claimed.
Larry Barton, the mayor of Talladega, was recorded on video having sex with his once-colleague Benny Green's wife, Charlotte, in the back office of a liquor store, Green's former attorney claims.
The alleged sex sessions were cited in divorce court papers. Although Barton is not identified by name in the papers, Green's ex-lawyer, Stewart Spring, says he was the man in the sex tape.
On Saturday, Barton was climbing out of his car outside a barber shop where he works part time when he was ambushed by Green, who was wielding a baseball bat or a similar item, police said.

He was then repeatedly struck in the head with the object outside Chaba Heights Plaza Barbershop in Vestavia Hills, around 55 miles west of Talladega, forcing him back into the car, it is alleged.
As he sat in the driver's seat, Barto, who is married, fought back. 'I was able to kick him twice - hard. He fell on the ground,' the mayor told AL.com. 'If I hadn't kicked him twice in the balls I'd be dead.'
After the alleged assault, Green, a former co-host of Barton's radio show 'In the Interest of the People', attempted to flee the scene on a bicycle, it is reported. However, he was stopped by bystanders.

Barton was taken to an area hospital with bad bruising following the alleged attack, which occurred shortly before 8am. He remains at the facility, but is expected to make a full recovery, it is reported.
On Monday, Springer told the Associated Press that Barton's alleged sex tape with Green's soon-to-be ex-wife likely drove his ex-client to wait outside the barber shop for Barton to arrive at work.

He said that Green had set up a video camera in the back office of a liquor store that he and Mrs Green own - and had caught the mayor and his wife engaging in sexual activity several times on it.
These sessions are alleged to have taken place in the last few years.
Speaking to The Daily Home, Springer described the pair's supposed sexual acts as 'full blown'.
'It gives me hope for when I'm 70,' the attorney said. He added that there is 'absolutely no question' that Barton is the man on the tape, which is apparently cited in the Greens' divorce court papers.
However, the mayor, who was subpoenaed to give a deposition in the Greens' divorce case, has denied any involvement with Mrs Green.

He says he has no idea why he was allegedly attacked as he went to work on Saturday.

It is not the first time Barton has been embroiled in a scandal. In the 1990s, the mayor served around three years in prison after being convicted of stealing money from the city of Talladega.
Barton lost runoffs for mayor in 1999 and 2003 before being elected again in 2011. He is again on the ballot for elections to be held later this month, according to Talladega City Clerk Beth Cheeks.
Green's current divorce lawyer declined to comment on the alleged attack and sex tapes.
Springer, meanwhile, plans to set up a GoFundMe page to help pay Green's defense costs.
'If Benny did this, he would have had reason to do it,' Springer said.
'And if he did it, I want him to be defended and I don't want him to get in any trouble.'
According to Barton's Facebook page, he has been married to his wife Mary for more than 55 years. In 2012, the father of one wrote that he was lucky to have a 'beautiful and faithful' wife.

Abortion Advocates Confronted With Evidence Of Sale of Body Parts of Aborted Fetuses

Last week, Breitbart.com identified StemExpress as a company to which Planned Parenthood sold aborted baby parts. (Oh, I forgot again. Planned Parenthood didn’t sell the parts or, God forbid, make profit on the death of the unborn. They just covered the shipping costs.)
Since then, StemExpress has doubled down, making it clear that they are proud of their work:
“We are proud of the role we play in helping the global research community as they strive to achieve medical breakthroughs to stamp out global disease and improve quality of life. Everything we provide is solely at the request of the nation’s and the world’s great research institutions.”
So there’s the justification: We are saving lives in the process, so what we’re doing is good.

How does the allegedly humanitarian use of a barbarically obtained item justify (or, even minimize) the barbarous practice? And since Planned Parenthood makes more money the more babies it aborts, and since StemExpress is surely a for-profit company, doesn’t that mean that the more abortions, the more profits for all?

Defenders of Planned Parenthood kept sinking their ship deeper last week, first claiming, “That undercover sting video was heavily edited to give a misleading impression!” In response, The Center for Medical Research, which filmed the video, posted the entire footage, 2 hours and 42 minutes long. They even released a full transcript more than 60 pages.
Next, the defenders claimed, “Well, Planned Parenthood didn’t sell the baby parts. They simply donated them, but shipping costs have to be covered.”

These consent videos are saved to a cloud file. If hackers are getting into US government data bases how long before they get into these video files and use them for ridicule, divorce cases, and more. This is more idiotic business ideas which exploits human  weaknesses. One more reaction to the extreme, misguided attempts to end sex offenses.

A breathy female British voice asks participants to state their name and to agree to sex. Once the video has been completed the voice says: ‘Consent confirmed. Have fun.’ The video is then saved in a ‘cloud’ or server.
Mr Lissick, 57, said: ‘The videos are twice encrypted and can only be accessed by law enforcement, by a written judge’s order or as part on an ongoing sexual investigation by a college.’
More than 100 people in the UK have already downloaded it.

Sex contracts are being encouraged widely in American colleges. University of Massachusetts student Noah Convicer, 21, has used the WeConsent app several times and said: ‘It’s a great idea. I don’t feel embarrassed asking a girl to consent to sex on video. It protects both of us and it is a mature and responsible thing to do. I use apps for everything else, so why not this?’
Sally Bratton, who sits on the board of the Health Services Association for Californian Community Colleges, which represents two million students on 112 campuses, said: ‘These contracts are a very good idea. They take away any doubt or misunderstanding, which is one of the leading causes of accusations of sexual assault. When you have apps like Tinder making sex purely recreational, why not have an app or contract to protect yourself?’ But Jasmin Enriquez, 23, who was date-raped as a student at Pennsylvania State University, branded sex contracts ‘pure evil’, saying: ‘They are nothing more than stunts and money-generating schemes which distract from the real issue which is education. We need to educate students of both sexes. Informed consent is an ongoing, shifting process which cannot be encapsulated in a contract. A contract fails to safeguard a woman who might change her mind after signing it.’
And Susuana Amoah, women’s officer at the UK’s National Union of Students, said: ‘The idea that consent could be given through an app is a really dangerous notion – this type of technology isn’t the answer to developing better sexual consent behaviour. We shouldn’t be encouraging students to equate consent with “there’s an app for that” – we should be encouraging them to engage in on-going discussions about consent and boundaries.’

Sharyl Attkisson Reveals Federal Government Uses Taxpayer Funds To Produce Sophisticated Propaganda

Attkisson said the federal government has adopted many public affairs strategies used by large corporations, except the government is using public funds to “advance its propaganda.”
“One way they do it is by self-producing videos and building their very own television production facilities where the upper echelon give interviews and speeches, controlling everything from content to lighting,” she said.
According to Attkisson, the Department of Health and Human Services (HHS) and the National Institutes of Health (NIH) use millions of taxpayer dollars to expand or create their own television studios. Attkisson said the FDA has a studio that can fit a live audience of 100 people and the Transportation Security Administration (TSA) has a studio with Hitachi high-definition cameras and LCD-based teleprompters.
“When top officials from those federal agencies appear on camera, naturally they have to look good. So your tax dollars may kick in for the cost of their hairstylists, makeup artists and wardrobe consultants,” she said. “One insider told me that the head of a federal agency even had her fashion colors analyzed at taxpayer expense.”

A few years ago, a well-placed insider at the U.S. Department of Agriculture told Attkisson he was surprised to learn there were more than 1,200 “media relations employees” on staff.

In my view and that of other national reporters, this is proving to be the least transparent administration we’ve covered,” she said. “It’s so bad that practically every major news outlet including the CBS News,Washington Post and the New York Times signed a scathing letter to the White House in 2013 objecting to restrictions on the press that are unprecedented, that we have not dealt with before.”

Video Better Than Science at Harvard Law School?




This essay by a Harvard University Law School  student makes one accurate statement, i.e., that cameras worn by police reduce the number of citizen complaints about police abuse. The rest is questionable. Saying it was not until "TMZ released the video of Rice's knockout punch in the hotel elevator to the public. [. . .] the executives doling out the repercussions could not ignore the realities of domestic violence." That avoids the lack of spine, and relaxed rectitude of the leadership of the NFL. They knew what Rice did. He admitted he punched his then fiancé. Cameras were present on and near the elevator showing that the woman was unconscious. NFL officials saw the elevator video too before it was released to the public. They did nothing. This essay misses the fact that NFL leadership failed to act.

Another element missing from this discussion is medical evidence. Two autopsies were conducted (and a third ordered) showing that Mr. Brown had his hands down when he was shot. Long before video cameras were used, medical examiners were able to determine what caused injuries and why people died. Are cameras better than science? 




One conclusion that "state and federal legislation is necessary to ensure that all police departments are equipped with dashboard and body-worn cameras." is wishful thinking and offensive to the constitutional system of government. Also missing is any discussion of the role of the NJ prosecutor (a lawyer) in the Rice assault. Harvard Law School and Columbia Law School apparently do not teach their students about the role of the constitution. See e.g., Eric "White people are cowards" Holder, and his mentor Barack "Typical white person" Obama. Domestic violence and homicide are state crimes. Having more laws and allowing the US government to take jurisdiction contrary to law, and to dictate how to run local police departments, will not reduce those crimes. 

Saying "The footage of Ray Rice's brutal assault reveals the urgent need for body-worn cameras on cops to capture independent, visual evidence" does not make sense. Even if police were required under penalty of death to wear video cameras, no policeman was present when Janay was punched out by Ray Rice. This indicates a pervasive misguided belief in the magical powers of cameras. Medical science helps to solve crime too. Not just video cameras.

Terror Group Releases Video Killing Spree

Al-Qaeda linked terrorists that control swathes of Iraq and Syria have circulated a video compilation of hundreds of graphic executions to mark the Muslim religious festival of Eid.
Accompanied by an explicit threat to Iraqi soldiers , the group formerly known as the Islamic State of Iraq and al-Sham (Isis), showed dozens of young men men cowering in the shadow of gunmen before being brutally slaughtered.
A group of soldiers are led to a desert pit that will soon become a mass grave.
Others are seen standing on a small river jetty before shuffling forward where they are shot in the head and fall into the water. The executions take place in Saddam Hussein's hometown Tikrit.

Video Games Beneficial To Youth

To many it might seem counter-intuitive, but researchers have found that playing video games – including violent shooter titles – may boost children’s learning, health and social skills.
This conclusion comes from a review of studies into the influence of video games that will be published in the American Psychological Association’s flagship journal, American Psychologist.

Visit Italy By Video




This DVD is appreciated even by people who have visited Italy. There are three discs, with four parts. Northern and Southern Italy. One for Sicily, and one for the Great Cities. The photography is outstanding. The narration audio is not excellent.  The beauty of the structures makes modern architecture look lame. Churches, homes, walls, theaters, shrines, beaches, mountains, bridges encourage you to make reservations to go see some more. To think that real people live in these magnificent cities and towns.

of how it works, and why it is flawed. There were no users at the conferences when the law was written, somewhat like Obamacare. It has a three-pronged test. But it is easy for providers to abuse it's intent. YouTube e.g., only requires a complaint of a violation by "the copyright holder." They do not verify that the complaint is actually from him or her. One Boston cop filed numerous complaints about my legal postings, pretending to be the "copyright holder," and caused me a lot of trouble until he was arrested. The automatic takedown can be undone by filing a defense claim i.e., that Fair Use or other notion permits use. The alleged copyright holder has ten days to file a lawsuit. If not the item goes back up automatically.

One problem with many providers is that they are clueless about the notion of Fair Use. One author of a video editing book supported by Apple Computers has comments barred from Apple Discussions about Fair Use, due to ignorance. He is an expert on the video program but is clueless about the law. At one Cable Access TV station (Cambridge MA) the entire management was clueless about Fair Use and warned everyone about using any part of another's audio or video. Wouldn't it be helpful if at least the management understood the laws protecting expression? Aufderheide's essay shows Fair Use law is extended beyond the legal limits in good and bad ways.
