Kentucky Police Capture Gentleman Who Escaped From Georgia Prison 37 Years Ago

Billy Burchfield was serving a 16-year sentence for manslaughter when he escaped 37 years ago and had been on the run ever since.

[From article]
A man who escaped from prison in 1979 and eluded authorities for nearly four decades has been arrested in eastern Kentucky, police say.
Billy Burchfield was serving a 16-year sentence for manslaughter in a Georgia jail when he broke out 37 years ago - and he has been on the run from the law ever since.
Police say the 67-year-old stole the identity of his cousin Harold Arnold after he died and was living under that alias when the cops finally caught up with him.
Laurel County Police say they were able to track down Burchfield after receiving a tip from law enforcement in Jackson County, Georgia that he was living as Arnold in the area.
Detectives went to a house in Laurel County on Wednesday night and spoke with the occupant who denied any knowledge of Burchfield.
But after he submitted for fingerprinting, Kentucky State Police fingerprint technicians and the FBI were able to determine that he was a match for Burchfield.
Gilbert Acciardo, spokesman for Laurel County Police Department, said Burchfield had lived without incident in the county since fleeing jail.
'Probably somebody like that is going to fly under the radar,' Acciardo said. 'You (would) have to keep your nose extremely clean and apparently that's what he's done.'
When he was approached by police on Wednesday night, he denied he was a fugitive and continued to deny it after being fingerprinted, Acciardo said.
'He's saying he's not that person,' Acciardo said.
No one answered the phone Thursday at a phone number listed at the London, Kentucky, address where Burchfield was living as Harold Arnold.
Burchfield is being held in Kentucky as a fugitive until he is extradited back to Georgia, Acciardo said.

Updated: Gentle Woman On Trial For Shooting Lawyer Boyfriend Dead; Alleging He Called Her A Hillbilly.

Posted October 27, 2012 4:33 PM ET; Last updated August 4, 2015 8:36 PM ET

Troubled: Poston's family described his relationship with Hubers,
left, as tumultuous and said that the 29-year-old was trying to end it

Don't know enough about this young lady. But my reaction is that she may have felt humiliated by this young man. Maybe he did consider her a hillbilly, and beneath him. It may be the same class difference (real or imagined) as between Travis Alexander and Jodi Arias. Many people have poor or low self esteem. The testimony in the Arias trial showed that she was devoted to Travis and wanted to marry him. He seemed to be treating her as his sex slave which she was willing to be. She just wanted to marry the guy. When  he expressed his disdain for her, she lost it and killed him.

That is not to say she was justified in killing him. Nor was Jayna in this murder either. Just that it may explain why it happened, and that there is no method for bringing that into the trial. Classism is seldom discussed or mentioned when it comes to bias and discrimination. If these men had expressed their dislike for the women for being black or lesbians they might have been able to use that bias, hate speech, as justification for murder. "He insulted me. He called me a N-word." "He called me a hillbilly." and "He called me a cripple." do not work as easily.

[From article]
The night that Ryan Poston was shot dead by his on-again, off-again girlfriend he was supposed to meet a former Miss Ohio 2012 beauty queen for a date, an Ohio court heard on Thursday.
Audrey Bolte, who also finished runner-up in Miss USA, told prosecutors she was looking forward to seeing Poston, 29, at a bar to play pool and drink on October 12, 2012, but he failed to arrive.
That was because Shayna Hubers had shot him six times at home - during which she allegedly 'cackled' with glee claimed a cellmate of the accused, who claims the 24-year-old confessed to her while behind bars.
[. . .]
Prosecutors allege that Hubers shot Poston because she was furious he was trying to break up with her.
Hubers, who was 21 at the time, denies murdering her lawyer boyfriend and claims she shot him in self-defense.
Her trial began on Monday and during that time, Hubers has been held at the Campbell County jail in Newport.
Her romer cellmate testified to the court that Hubers joked about the shooting and said she was going to get off all charges.
'Did she ever laugh?' Commonwealth's Attorney Michelle Snodgrass asked Cecily Miller according to Cincinnati.com.
'Oh, yes.'
'About what?'
'About shooting him in the face and giving him the nose job he always wanted,' said Miller. 'That's what bothered me – she cackled.'

Trial: Shayna Hubers attends her murder trail in Campbell, Ohio. Hubers is charged with murder in the shooting death of her boyfriend, Ryan Poston.

[. . .]
Also on the stand was Vernon West, who lived in the condo below Poston with his wife Doris.
They testified they returned home at around 8.30pm and heard a woman crying on a balcony above.
West said that she returned inside the home at around 8.50pm and then he heard two pops that at first he thought were fireworks and then four more and then a thud.
'The first two shots, I thought might have been fireworks,' Vernon West testified according to Cincinnati.com.
'But a few seconds later, I heard four shots, and I knew that wasn't fireworks.'
Vernon West also said that they did not hear a physical fight or arguing before the shots.
Hubers, who was 21 at the time, claimed she was acting in self-defense because the young attorney was shoving and hitting her, but during an interview with police she was quoted as telling a detective she gave Posten 'the nose job he wanted.'
On the first day of testimony Tuesday, jurors were shown a video of the defendant's interview with police following the slaying.
'He was screaming at me at the top of his lungs after he had thrown me around the room,' the woman told a detective sitting across from her, reported Cincinnati.com.
'I shot him enough times to kill him,' she said, 'so that he wouldn't suffer... He was laying there, twitching and making noises, and I shot him in the head.
'I was watching him die. it was painful to watch him die and to know that I had done that,' reported WCPO.
Hubers then described her late boyfriend of one year as 'vain' about his looks.
'I shot him right here,' she said in the video as she pointed to her nose. 'I gave him his nose job he wanted.'
[. . .]
'He said, 'You're just a hillbilly from Kentucky.' And I am. I guess the hillbilly came out in me, and I took up for myself,' she told police in the recording played in court.
[. . .]
Hubers graduated from Lexington's Paul Laurence Dunbar High School in 2009.
In the fall of 2010, she made the Dean's List at the University of Kentucky as a sophomore psychology major. Zevely said she is close with her parents, and her mother spent the day with her in Northern Kentucky prior to the shooting.

Kentucky Mother of Five Missing

Rogers pictured with her five children. Houck is the father of Rogers' 2-year-old son.

[From article]
The search for a missing mother in Kentucky is eerily similar to the disappearance of her aunt, who vanished nearly 40 years ago.
[. . .]
Crystal Rogers, a 35-year-old mother of five, was last seen at her Bardstown home on July 3 by her live-in boyfriend, Brooks Houck. Bardstown is a small city located roughly 60 miles southwest of Lexington.
According to Nelson County Sheriff Ed Mattingly, Houck told police Rogers had stayed up late on the night of her disappearance and was gone when he woke up the following morning.
Houck waited two days to report Rogers missing, police said.
Rogers' vehicle, a maroon 2007 Chevy Impala, was found abandoned with a flat tire along Kentucky's Bluegrass Parkway two days after she disappeared. Rogers' keys, purse and cell phone were reportedly found inside the car.
[. . .]
Rogers' disappearance is not the first time her family has had to search for a missing loved one. In 1979, her aunt, Sherry Ballard Barnes, 19, disappeared from Bardstown. Her vehicle was found submerged in the Ohio River, but investigators found no sign of the teen.
"They searched for years," Rogers' cousin, Andrew Ballard, told The Kentucky Standard. "She was pregnant."
Barnes' remains, along with those of her unborn child, were found buried in a rural area three years after her disappearance.
According to The Associated Press, Barnes' husband, Edsel "Eddie" Barnes, was arrested and ultimately convicted in 1984 of hiring a man to kill his estranged wife so he would not have to pay child support. Barnes was sentenced to life in prison.

The search has intensified for a missing Kentucky mother of five, who was last seen alive more than a week ago by her live-in boyfriend.
Crystal Rogers, 35, was last seen playing games on her phone on the night of July 3, claims boyfriend Brooks Houck, who said the mother to his 2-year-old son was not at home when he woke up the next morning.
Houck said he wasn't concerned because the couple has had a 'stressed relationship' at times and Crystal would sometimes 'cope or deal' by spending the night at her cousin Sabrina's house.

State Laws Inhibit Free Enterprise Contrary To Constitutionally Guaranteed Freedoms

[From article]
Kentucky, however, like some other states, requires movers to obtain a CON. Kentucky's statute says such certificates shall be issued if the applicant is "fit, willing and able properly to perform" moving services — and if he can demonstrate that existing moving services are "inadequate," and that the proposed service "is or will be required by the present or future public convenience and necessity."
Applicants must notify their prospective competitors, who can and often do file protests. This frequently requires applicants to hire lawyers for the hearings. There they bear the burden of proving current inadequacies and future necessities. And they usually lose. From 2007 to 2012, 39 Kentucky applications for CONs drew 114 protests — none from the general public, all from moving companies. Only three of the 39 persevered through the hearing gantlet; all three were denied CONs.
[. . .]
"The principle is imbedded in our constitutional system that there are certain essentials of liberty with which the state is not entitled to dispense," including "the opportunity to apply one's labor and skill in an ordinary occupation."
[. . .]
socialism's knowledge problem: For government to supplant markets in the efficient allocation of wealth and opportunity, governments must have infinite information to make them clairvoyant.
[. . .]
Judicial tolerance of CON laws is a result of judges embracing the "rational basis" excuse for retreating from judging. Such judges are either confessing that they cannot fathom basic political processes or they are saying that they cannot trust themselves to recognize brazen, unapologetic rent-seeking when they see it.

[From article]
Police say Hunter was killed when he and his friend were headed back to their hotel after Kentucky Derby.
"It's extremely unfortunate and tragic,” said Lt. Todd Kessinger, with the LMPD Homicide Unit.
Police worked on the case all weekend and arrested Fahed Abu-Diab, Fatima Abu-Diab and Tyrone Thomas Jr.
"Two are brother and sister and the third is the boyfriend of the sister,” Kessinger said.
Police say they'd been committing robberies all weekend.
[. . .]
All suspects were interviewed by police and gave statements indicating their involvement in the robberies and homicide.
Fahed and Fatima Abu-Diab are charged with murder.
Thomas is charged with complicity to murder.
All three are facing nearly a dozen robbery charges and Fatima Abu-Diab is also facing a possession of a controlled substance charge.
Lt. Kessinger says Hunter and his friend may have tried to fight off the suspected robbers before he was killed.
"I absolutely think the gun was intentionally fired but I can't really get into the details of the actual struggle,” he said.
One of the suspects, Fahed Abu-Diab, has a history of violence.

Kentucky Man Fugitive For 40 Years, Surrenders To Get Health Care

Clarence David Moore, at 28

[From article]
Frail and tired of leading a secret life for four decades, 66-year-old Clarence David Moore called police this week to surrender. The deputy who answered thought it was a prank. It wasn’t.
Moore escaped from police custody three times during the 1970s and eventually settled into a quiet life, living in Kentucky since at least 2009. His health is poor from a stroke and he has difficulty speaking. Without a legitimate ID or Social Security number, he had apparently struggled to get medical care.

Kentucky State Senator Exercises Elected Official Privilege After Bust For Drunk Driving

Kentucky State Sen. Brandon Smith (R)

[From article]
A Kentucky state senator is having no reservations about proclaiming his political privilege. In fact, he’s simply citing a section of the Kentucky constitution that claims politicians are in fact, above the law.
Sen. Brandon Smith (R) was charged with driving under the influence and wants the case dismissed citing that lawmakers are “privileged from arrest.”
His attempt to circumvent the hand of justice have thus far proven to be successful too. On Wednesday a judge delayed Smith’s arraignment after his attorney filed this request.
“(Smith) has raised a serious constitutional issue regarding his immunity in this case,” attorney Bill Johnson wrote.
[. . .]
The State Journal reports that according to the citation, Smith was stopped on Village Drive after he was seen driving 65 mph in a 45 mph zone on Leestown Road, near the intersection of Copperleaf Boulevard. The trooper described several failed field sobriety tests and said Smith blew a .088 on a preliminary breath test.
Once in the custody of police at the Franklin County Regional Jail, he refused an official breathalyzer. Under state law, refusing a breathalyzer is an automatic suspension of one’s license.
[. . .]
According to the Kentucky law, the senator could have also been caught breaking the following misdemeanor laws of pimping out prostitutes, possessed meth, stolen prescription drugs, used stolen credit cards, and received stolen goods and he would simply have to claim political immunity, and the charges are then rendered invalid. Seems legit.

She had to slow Mylute. The winner Orb, Joel Rosario up, stayed back, just ahead of her. When the winner Orb, made his move she was right behind him all the way to the top of the stretch, where one horse then another moved toward her forcing her to go wide further from the rail. Police Focus on Little Guy

Police Focus on Little Guy

Hi Janie,
You are correct in your analysis. There is a book called, "Peroff," about a man named Robert Peroff, who did the Secret Service a favor and they destroyed his life, forcing him to report on a drug gang in Montreal.
In Boston MA the police have difficulty getting young people, even victims of crime to cooperate with their investigations. The politicians wonder why. I tell them over and over again, that they are the problem.
They avoid accountability and refuse to talk about police abuses. Young people know what is going on. The FBI in Boston was killing people who were reporting on criminal enterprises of FBI informants. That happened also in NYC.
So it is a problem that will only get worse until enough people stand up and throw out the current crop of spineless politicians. I would like to publish your comments in response to this article on my blog. Do I have your permission?

Just like in the medical field "There aint no money in curing an illness, just in treating it" If cops busted the dealers instead of the users, they would stem the flow. As long as they bust the "middle men" and the casual users, they keep the funds rolling in. As far as rolling over or being a CI, try it once. If you inform, first of all, that means that whoever you informed on and their friends/bosses/etc. are after you. Beyond that, even if the deal gets you off, the cops are never going to leave you alone, you become an expendable pawn in their game. Used whenever they need a rat. See, you might just get probation or diversion, but everytime the cops send you to buy drugs, you're violating that. So, you can get hit with your initial time and more whenever they choose. If the dealers don't "deal" with you first. I'm not saying anyone in this case is innocent, but, know how the system works. The "war on drugs" is nothing but an money-making scheme. And a very good one, at that. Fill the prisons with non-violent drug offenders, let the rapists out, keep the $$$ rolling in. My sympathy to the families of these kids, and my...well...fear?...for the kids themselves.

Organized-crime indictments delivered
By SHARON DODSON, Staff Writer
Commonwealth Journal (Somerset, KY)
February 24, 2007
Somerset— Four men have been indicted on drug-related charges they were behind a criminal syndicate that operated here for nearly a year.Floyd Cowan, 30, Issac Leon Sanders, 31, Ameer Miller, 28, and James David Cook, 29, are accused of being part of an organized crime ring with ties to illegal drug trafficking.
UNITE prosecutor David Dalton said the latest indictments are the final charges to be filed in a multi-agency probe into the sell of crack cocaine in Pulaski County. The investigation wrapped up last year and covered a 12-month period, beginning in 2005.Last October, Dalton said, several individuals were arrested and charged with drug trafficking as a result of the investigation.
“Based on information we received during the course of those prosecutions,” he said, “we were able to build our syndicate case.”The four suspects are charged with “working with other people,” Dalton said, the basis for what Kentucky statutes consider to be a criminal syndicate in a drug-trafficking case.In the indictments, they are charged with one count each of “engaging in organized crime by, with the purpose to establish or maintain a criminal syndicate, or to facilitate any of its activities, collaborating to promote or engage in the trafficking of controlled substances as prohibited in KRS Chapter 218A with at least four other persons.”
Indictments were returned last week by a Pulaski County grand jury. Cook and Miller face additional charges of being first-degree persistent felony offenders for previously being convicted of at least two prior felonies. All four have been in trouble with the law in the past.
According to Pulaski County Sheriff Todd Wood, Miller is wanted on four outstanding warrants. Cook pleaded guilty to first-degree trafficking in a controlled substance and is serving a seven-year sentence on that charge. Sanders and Cowan also face multiple charges of trafficking in a controlled substance.
Dalton prosecutes drug cases for the commonwealth’s attorney’s office and UNITE, a non-profit agency that serves Pulaski and other counties in the 5th Congressional District.Copyright © 1999-2006 cnhi, inc.
