Reducing Accountability at University of California




Considering that the current UC president is a former government bureaucrat, it is no surprise that accountability is offensive to her. Consolidation of power is always good for bureaucratic incompetents.

Proposed changes in the governance of the University of California System would empower its president, former Homeland Security Secretary Janet Napolitano, with greatly enhanced autonomy by hamstringing the principal check on her power, the Regents. Regents of the University of California are entrusted with the supervision of a vast enterprise with an annual budget of over $25 billion, comprising 10 campuses, and employing almost 20,000 professors and 135,900 support staff, all ultimately reporting to Napolitano.
University of California Regents begin their terms with an oath to serve as fiduciaries -- legally obligated to act solely in the best interests of the people of California. Preserving the Regents’ authority to protect the University is even more important now that the State of California contributes only a small fraction of UC’s budget.

At the July 2016 Regents Meeting, they will vote whether to change the Regents’ Board governance procedures in ways that would diminish the power of the Regents relative to UC President Janet Napolitano’s administration. Napolitano already has demonstrated a reluctance to consult the Academic Senate on issues such as pension reform and disciplining UC Davis Chancellor Katehi, and, according to Regent Rodney Davis, failed to inform Regents of Katehi’s response to Napolitano’s allegations.

A major change would rescind the longstanding authority of an individual Regent to place any item on the Regents’ meeting agenda. This authority proved an important bargaining tool when certain Regents balked at the Administration’s proposed UC Statement of Principles Against Intolerance, enabling Regents to craft a statement acceptable to civil libertarians from both the left and right of the political spectrum.

Some Regents argue that the proposed governance changes could be tried for a year, and then reconsidered. Once implemented, however, it likely would be impossible for now less-powerful Regents to regain their lost authority.
As they did with the proposed Intolerance Principles, the UC Regents should call time out to consider governance changes, and concentrate on enhancing their role as fiduciaries. Included in these considerations should be whether to rescind the relatively recent change to have the General Counsel report not only to the Board but also to the UC President. The General Counsel cannot properly serve two masters. Another consideration should be whether, like UC Academic Senate members who choose to remain non-voting members, the UC President’s Board membership should be changed to a non-voting member. In almost all public university boards, the president is a non-voting, ex-officio (serving while holding the office) member. The UC President reports to the Board, after all.

Equality Advocates Protest Unlawful Misuse of Taxpayer Funds Favoring Black Students

The $20 million fund unveiled by a top California university last month to endow scholarships for African-American students and to hire diverse faculty is just the latest attempt to get around a state law barring schools from using racial preferences in admissions, according to critics, who are vowing yet another legal battle.



University of California-Berkeley's "African-American Initiative" would raise funds from private non-profits to fund “a comprehensive effort to address the underrepresentation of African-American students, faculty and staff at our university, and improve the climate for those who are here now and all who will join our community in the future.” The money would go to scholarships for black students, the hiring of race-specific clinical psychologists and fostering a more diverse faculty and senior management, according to the school.

But critics say the scholarship fund is an end-run around Proposition 209, the 1996 law barring state institutions from considering race, sex, or ethnicity for public employment, contracting and education. Ward Connerly, a conservative African-American who served on the University of California Board of Regents from 1993-2005 and is considered one of the architects of Prop 209, said the initiative appears to be illegal.
“The University of California, especially Berkeley and UCLA, have long tried to circumvent the law when it comes to this,” Connerly told FoxNews.com. “We are a nation of laws and Berkeley is not above them. The school has no right to avoid the law by developing initiatives such as this.”
Prop 209's backers claim it was modeled after the Civil Rights Act of 1964, which barred race as a factor in an effort to protect African-Americans from discrimination. By using similar language more than three decades later, the measure's proponents sought to stop racial preferences. University of California schools have seen higher graduation rates among minority students since Prop 209 took effect, with the Berkeley campus alone seeing a 6.5-percent increase in graduating students. But despite the rise in graduation rates, raw enrollment rates among African-Americans has dropped.

While private scholarships can legally use race as a consideration, Cal-Berkeley's involvement in creating and administering the endowment could be viewed as violating the law's intent, according to [Ward] Connerly.
“I intend to ask the Pacific Legal Foundation to take a look and if there’s any wrongdoing found, we will sue,” he said. “If we allow them to disregard the law, then they will try to do more and more.”
Gail Heriot, University of San Diego law professor and expert on Prop 209, told The College Fix the scheme does appear to violate the law.
“If the initiative is as described in the university’s announcement, it is a straightforward violation of Proposition 209,” Heriot said.

College Students Need Protection From College Administrators

A more insulting and mindless exercise would be hard to imagine. But Napolitano’s seminar possesses a larger significance: it demolishes any remaining hope that college administrators possess a firmer grip on reality than the narcissistic students over whom they preside.

Well, you might ask any high school senior, steeped in his class’s SAT rankings, if it’s true that “people of color” are given “extra benefits” in college admissions. He will laugh at your naïveté. A 2004 study of three top-tier universities, published in Social Science Quarterly, found that blacks were favored over whites by a factor of 5.5 and that being black got students an extra 230 SAT points on a 1,600-point scale. Such massive preferences for URMs are found at every selective college and graduate school. Every student knows this, and yet diversity protocol requires pretending that preferences don’t exist.

The ultimate question raised by the seminar is: Are there any adults left on campus, at least in administrative offices? And the answer is: no. An adult administrator would realize that he is presiding over the most tolerant, well-meaning, and opportunity-filled community in human history. He would understand that the claim that females and minorities are the victims of discrimination on campuses is sheer fiction.

The most disturbing aspect of “Fostering Inclusive Excellence” is that it was initiated by the president’s office without outside provocation.

We have come to expect such ignorance from coddled, self-engrossed students. Now it turns out that those students may be the least of the university’s problems.

University of California Professor Exposed as Claiming Fake Indian Heritage

Andrea Smith, a professor of media and cultural studies at the University of California at Riverside, has started to draw attention in the wake of the Dolezal incident from those who say she has for years falsely claimed to have Cherokee blood. The case is arguably much more significant, though, because while Dolezal was a relatively undistinguished academic at Eastern Washington University, Smith is recognized as a significant scholar in her field. She routinely appears as a featured scholar at major events and has written books that were well-received by her colleagues

David Cornsilk, a Cherokee genealogist, who says he actually researched Smith’s heritage back in 1993 (while she was still an undergraduate) at her request and found absolutely no evidence of Cherokee heritage. Cornsilk says Smith actually approached him a second time in 1997 to look again, allegedly telling him “her employment depended on finding proof of Indian heritage.” Once again, Cornsilk found nothing.
But that apparently didn’t deter Smith, who simply continued to claim Cherokee heritage directly or allow others to attribute that heritage to her. In 2008, her failed tenure bid at the University of Michigan caused a significant backlash, with activists claiming the school was marginalizing minority women.

but apparently even Smith’s siblings may be getting in on the fraud. An article published by Russell on July 1 accuses Justine Smith, Andrea’s sister, of not only falsely claiming Cherokee heritage but also getting a fake tribal ID card.

Student Opponents of Free Speech Ban Flags





This student law, may suit the opponents of free speech, and one world proponents. But the University of California is a state school. This student legislation violates the First Amendment which trumps student laws.

The Associated Students of University of California, Irvine (ASUCI) voted Tuesday to remove all flags, including American flags, from an inclusive space on campus because of their offensive nature.
The bill, R50-70, was authored by Social Ecology Representative Matthew Guevara, and accuses all flags, especially, the American flag, of being “symbols of patriotism or weapons for nationalism.”
“[F]lags construct paradigms of conformity and sets [sic] homogenized standards for others to obtain which in this country typically are idolized as freedom, equality, and democracy,” the bill reads.

“[F]reedom of speech, in a space that aims to be as inclusive as possible[,] can be interpreted as hate speech,” the bill reads.

The legislation resolved that any decoration that a student finds offensive will be removed from the Associate Student main lobby if the request is made.

Anti-Israel activists at the University of California, Davis heckled Jewish students and shouted “Allahu Akbar” at them during a vote last week on a resolution endorsing a boycott of the Jewish state, according to video of the event obtained by the Washington Free Beacon.
The commotion erupted late Thursday evening as pro-Israel students attempted to counter a student government resolution to divest from Israel as part of the Boycott, Divestment, and Sanctions (BDS) movement.
Activists waving Palestinian flags shouted at the Jewish and pro-Israel students as they left the meeting room ahead of an eight to two vote in favor of the divestment resolution, which is part of a larger movement by anti-Israel groups to attack Israel and pro-Israel students on campus.

Following the vote, which was championed by the pro-Hamas group Students for Justice in Palestine (SJP), unknown vandals spray-painted swastikas on a fraternity house belonging to the Jewish AEPi organization.
Additionally, Azka Fayyaz, a member of the U.C. Davis student senate, posted on her Facebook page a triumphant message following the vote: “Hamas & Sharia law have taken over UC Davis.”

UCLA Adds Cuba For Study Abroad, Removes Israel

Students who charge the Israeli government with human rights violations, yet embrace Cuban diplomacy on campus, should be charged with fraud. They fail to acknowledge their double standards with regards to human rights. The very existence of the Israeli government is a protecting rock for Israelis and neighboring Palestinians, while the Cuban government has for years defamed its own people. Israel is the only legitimate democratic country in the Middle East, and it provides protection and necessary benefits to its citizens and none-citizens alike; Cuba continues to torture, enslave, and rob from its citizens while supporting worldwide terrorism and forming close ties with other corrupt dictatorships such as Iran and North Korea.
This is, unfortunately, an indication that our university leadership does not care about human rights as it falsely advertises. Cuba was added to the list of student destinations while Israel’s presence on that list is slowly fading.

CA Teacher's Union Supports Boycott of Israel





Resolution voted by 17 percent of the union members. New York's Mayor de Blasio was elected by 18 percent of New York City voters. One supporter of resolution stated that Israel is "the far more powerful country." There are about a 1.2 billion Muslims, in 49 Muslim dominated countries who want to destroy Israel a nation of about 8.2 million. Is this about the majority trying to destroy a minority, and preventing the minority from defending itself?

A local branch of the United Auto Workers has become the first U.S. labor organization to join the international movement to boycott Israel, according to liberal groups.
UAW Local 2865, which represents teaching assistants at the University of California, voted to join it on Dec. 4, saying that Israel was engaging in "ongoing human rights violations" against the Palestinians.
A total of 66 percent of the members backed joining the movement, which supporters call "Boycott, Divestment and Sanctions against Israel." Only 2,168 members participated in the Dec. 4 vote, a small fraction of Local 2865's reported 13,000 members.

University of California Woman Professor Sued By Student For Assault

The Life Legal Defense Foundation (LLDF) filed a civil suit Thursday against the University of California and Professor Mireille Miller-Young seeking “compensation for physical battery, property theft and civil rights violations” following an on-campus altercation in March with pro-life demonstrators.

After the Shorts filed a complaint, the professor told police that she felt she had “a moral right” to steal the sign and that she believed “she set a good example for her students” by encouraging them to help her.
Miller-Young entered a plea of "not guilty" to misdemeanor theft, battery and vandalism charges on April 4th before changing her plea to "no contest" in July. She was sentenced to three years of probation, 108 hours of community service, and 10 hours of anger management classes.
“Miller-Young has not apologized for her physical attack on Thrin Short, nor has the university condemned the criminal actions of its employee, who remains listed in the faculty directory,” LLDF pointed out following the sentencing.

University Of California Teaches Online Abortion Course, Abstinence is Designated Hate Speech

The University of California – San Francisco will launch an online abortion course this Monday, an Internet class being hailed as the first of its kind.
The course will delve into “clinical aspects of medication abortion, aspiration abortion, post-abortion contraception, and pain management for abortion,” as well as topics such as the history of abortion, “abortion stigma,” complications and counseling, its outline states.
“I think that if we can inspire even a small portion of the people who take the course to take steps in their communities to increase access to safe abortion and decrease stigma about abortion, then we have been totally successful,” Dr. Jody Steinauer, associate professor of obstetrics, gynecology and reproductive sciences at the University of California – San Francisco, told The Daily Beast, which first reported on the class, noting an estimated 3,000 people have signed up so far.

Donna Harrison, executive director of the American Association of Pro-life Obstetricians and Gynecologists, told WORLD magazine that “obstetricians and gynecologists refuse to do abortions because they choose to adhere to the Hippocratic Oath, not because their education didn’t cover abortions.”
And National Right To Life’s Randall O’Bannon, its director of education and research, stated the reason most medical schools and med students shun learning how to perform abortions is because they “recognize that abortion is the killing of human beings.”

Letter to University of California Protesting Union Anti Semitism As Education


Dear President Napolitano,

We represent 12 organizations deeply concerned with the serious and growing problem of hate-filled rhetoric about Israel that sometimes rises to the level of antisemitism on campuses across the country, including at the University of California.

As you may be aware, the 83-member joint council of UAW 2865, representing all of the TA's, tutors and readers at the 9 teaching campuses of the University of California, issued a statement outlining the union's intent to support the anti-Israel and antisemitic Boycott, Divestment and Sanctions (BDS) movement, and to seek a full-membership vote on the statement this coming year.

While we support the right of every member of UAW 2865 to exercise his or her freedom of speech outside of the instructional setting, we are greatly concerned that these union members, who are responsible for instructing undergraduate students on 9 UC campuses, will bring their unscholarly, politically-motivated and antisemitic propaganda and advocacy into UC classrooms, where it certainly does not belong.

Alarmingly, the union leadership itself contends that as "educators", union members not only have the right to voice their antisemitic political opinions on the campus, but the responsibility to "educate" others about them:

"We have a responsibility as educators to both learn about and teach the social issues of our time, including pressing global struggles such as the struggle of the Palestinian people for liberation from settler-colonialism and apartheid."

Teaching undergraduate students one-sided propaganda which falsely alleges that Israel is a "settler colonial" and "apartheid" state worthy of elimination and promoting an antisemitic boycott of Israel do not constitute education but unabashed political indoctrination, which is expressly forbidden by the UC Regents in their Policy on Course Content (also known as the Regents Policy on Academic Freedom):

“[The Regents] are responsible to see that the University remain aloof from politics and never function as an instrument for the advance of partisan interest. Misuse of the classroom by, for example, allowing it to be used for political indoctrination… constitutes misuse of the University as an institution.”

Moreover, if TA's, tutors and readers feel free to "teach" anti-Israel propaganda and promote BDS to their undergraduates, it can't help but create a hostile, antisemitic environment for many Jewish students, who have already reported in the UC Jewish Student Campus Climate Report that campus-based BDS activities "project hostility, engender a feeling of isolation, and undermine Jewish students' sense of belonging and engagement." Other Jewish students on UC campuses have described feeling "continuously intimidated" and "repeatedly threatened," and that their personal and mental well-being, and even their physical safety, were jeopardized as a result of BDS campaigns on their campuses.

As UC President, you are responsible for ensuring that all University policies and rules are properly enforced, and that all students -- including Jewish students -- feel safe and supported on their UC campuses. We therefore urge you to do the following:

Publicly reaffirm the UC Regents Policy on Course Content and describe how you intend to enforce that policy in the coming academic year.

Provide public assurances that you will not allow UAW 2865 members to promote hateful antisemitic propaganda or the boycott of Israel as part of their contractual teaching responsibilities at the University of California.

Instruct the University's collective bargaining representatives to deny and resist any UAW Local 2865 proposals which seek to inject their biased and improper position on relations with Israel into the University's dealings with the UAW and the individuals whom the UAW claims to speak for.

Vigorously oppose any effort or proposal from UAW Local 2865 that any pension fund provided by the University for its employees adhere to any policies of divestment or boycott of businesses that directly or indirectly have business, cultural or academic relations with Israel, and its citizens and institutions of both its Government and civil society.

Thank you in advance for your attention to this serious and urgent matter. We look forward to hearing from you soon.

The one backing the professor, who has been charged with battery and vandalism, has more than 2,000 signatures, while the one in support of Short has 150, according to The College Fix.
“The last thing we need are these people invading our community,” UCSB sophomore Katherine Wehler, a theater and feminist studies major, told the site.
She said pro-lifers with graphic images of aborted fetuses such as Short and her sister carried are like “domestic terrorists.”
However, another petition making its way around the student body calls for Miller-Young’s termination.
“This is about someone who violated the law in several ways, disregarded the idea of freedom of speech, and tarnished the image of the UCSB,” it reads, before emphasizing that it is not a petition in support of the pro-life movement, but one advocating freedom of speech.
“They talk about prioritizing the safety of our campus involving activists, yet it’s our professor that attacks somebody,” UCSB student Katie Devlin told The College Fix. “I think it’s just the contrast that she is a feminist professor and stands for protecting women, yet she attacks a young girl.”

As defined by academia, “feminism” insults the beliefs and degrades the humanity and dignity of all girls and women. Miller-Young teaches pornography in a department that focuses on undergraduate and graduate degrees in lesbian, gay, bisexual, transgender, and queer studies. The values and aspirations of the majority of women are disrespected, while the aberrant is emphasized.

He will take a teaching post at Harvard College, but is still in the mix for the top homeland security post under President Obama and is exploring other potential opportunities, sources said.

President Eisenhower recognized the dangerous potential from the military industrial complex. Today there is a more sinister danger, the military industrial academic complex. Just as there exists a revolving door between the K Street lobbyists and the elected criminal class in Washington D.C., there appears to be a mini revolving door between Massachusetts government officials and Harvard University. Boston Police Commissioner Ed Davis is going to Harvard University, following the Cambridge City Manager. The Massachusetts economy is dominated by education. Harvard University dominates education. Laws are enforced unevenly in Cambridge and in Boston based upon the desires of the President and Fellows of Harvard College. If a law is inconvenient for Harvard's interests, the laws are ignored. 

Robert Healy another Lowell export served Harvard University's interests for 31 years as Cambridge City Manager. He is now employed by the $32 billion endowed University Leviathan. What courtesies did Commissioner Davis perform for this unmanageable non profit education institution that makes kings in a democracy? Davis appeared before Congress saying the FBI did not share information about the Boston Marathon bomber suspects. The FBI, Deslauriers said, did share information with the Joint Terrorism Task Force to which the Boston Police belongs. Richard Deslauriers retired and went to work as security chief for Penske Trucking in Michigan. Davis got a better gig. 

Janet Napolitano got an even better reward as President of the University of California with a $9,000 month house in  Oakland. Harvard University and Napolitano gave up freedom for security. Will Davis help Harvard University end any notion of freedom for residents of Massachusetts?

U. California Researchers Used Dying Patients For Experiments Without Consent

Still no penalties for violation of US laws using human subjects for experiments without consent. Defenders of this situation claim that banning the researchers from performing human experiments is punishment. Oh? How about if we ban murderers from committing murder when they are caught killing another person? Is that accountability as well? It shows how these morally superior, usually academics, get away with murder literally. They can kill human subjects and say they were enrolled in an experiment and not be held accountable. That actually happened in Boston. When I called Boston police to inquire if they investigated deaths in experiments at Harvard University Medical School teaching hospitals, they told me not to call again. The police spokesman told me the researchers do their own investigations. I asked if I was accused of killing would I be allowed to do the investigation? The DA and the Medical Examiner also did not investigate those deaths.
To suggest that the use of human subjects is strictly controlled is misleading if not completely false. There are no penalties under law. Unlike use of animals in experiments in violation of law, where there are fines and prison penalties. In addition what are the figures about oversight after 2000, when a Harvard psychiatrist was the director of the Office of Human Subjects Protection at the NIH, not the FDA, which regulates devices. The rules were loosened by this director.
