White House Fails To Protect US Civilians From Terrorism

The primary purpose of the federal governments was to provide for the common defense. Instead it collects taxes to make education policy, to force misguided standards on use of minerals and land, and many other activities outsides of the purview of the US Constitution which mandates those are matters for the states. Yet it fails to provide safety for civilians.

Every single error made on the federal level concerning terror since the first inauguration of Barack Obama came to a head, from encouraging Muslim immigration to enabling terrorists to enter the country to crippling security investigations in the name of PC.
The federal government has unilaterally broken a basic element of the social contract -- that the citizen will give up private use of violence and support the government in exchange for protection.

Both the military and police have given up any pretense of attempting to control Islamic terrorism. Homeland Defense was founded to create a new basis for a public employee’s union. It fulfills that role admirably. It does nothing else.

It explains why the borders have not been closed, why Jihadi mosques are still in operation, why Moslem Brotherhood operatives remain active within the government itself. The Muslims are the New Proletariat, the left’s ideological pets. The PC template has been shifted from blacks and placed right over the Muslim Jihadis, because they are Muslim Jihadis.

Chief Justice Roy Moore issued an order today saying that a ruling issued last March by the Alabama Supreme Court remains in effect and that probate judges "have a ministerial duty not to issue any marriage license contrary" to Alabama's law and constitutional amendment banning same-sex marriage.
In a four-page administrative order, Moore said the conflict between the state court ruling and the U.S. Supreme Court ruling in June has caused "confusion and uncertainty" among probate judges.
Moore said he issued the order today in his role as administrative head of the state court system. He quoted a state law that says the chief justice is empowered to "take affirmative and appropriate action to correct or alleviate any condition or situation adversely affecting the administration of justice within the state."

Moore, in his order today, says the Alabama Supreme Court continues to deliberate on how the U.S. Supreme Court ruling affects the state court's orders from March.
Moore said rulings by federal courts since the U.S. Supreme Court ruling could affect the issue in Alabama.
Moore said the Eighth Circuit Court of Appeals has ruled that the U.S. Supreme Court case invalidated only the same-sex marriage bans in Michigan, Kentucky, Ohio and Tennessee.
And he said the U.S. District Court in Kansas found that although the U.S. Supreme Court ruling "is clearly controlling Supreme Court precedent, it did not directly strike down the provisions of the Kansas Constitution and statutes that bar the issuance of same-sex marriage licenses."

Massachusetts Supreme Judicial Court Voids Town Ban on Drinking While Watching

The town of Mendon can’t ban alcohol at strip clubs because its restriction is too broad and violates the Massachusetts Constitution, the state’s highest court ruled today.
Showtime Entertainment was barred from selling alcohol at its prospective strip club after the town enacted bylaws “restricting the service of alcohol” in its adult entertainment district. The Supreme Judicial Court said the ban was overbroad and violated the state’s version of the First Amendment.
The SJC agreed that the town presented enough evidence to show that adult entertainment paired with alcohol would lead to increased crime. But, it ruled that the bylaw was too broad and thus unconstitutional.

The SJC ruling is the latest victory for Showtime. A federal appeals court ruled in favor of the company, indicating that limitations on the physical plant and operating hours were unconstitutional, The federal court sent the alcohol question to the SJC because it involved the interpretation of state law.

The proposed amendment clarifies that unreasonable searches and seizures may not be made of our digital data (i.e., e-mails and data stored on computers or cell phones). This is a logical extension of “papers and effects” from James Madison’s 18th-century version.
HJ 578 reverses what is known as the “third-party doctrine” so that people’s data stored in the cloud would be secure from unreasonable searches and seizures.
Since devices the size of birds used to spy on our backyards, fields, and pastures did not exist in the 18th century, the 21st-century Fourth Amendment includes “lands” as being protected.

The Mayor of the City of St. Louis, the Honorable Francis Slay, has openly, willfully violated the state constitutional ban on gay marriage
Mayor Slay, perhaps taking his cue from President Barack Obama, who enforces only laws he likes, married several homosexual partners in a ceremony at taxpayer-funded city hall, then watched as the happy couples fired up cigars in violation of the city smoking ban. Slay has done this ostensibly to set the stage for a legal challenge to the law, which was approved with 71% of the vote in 2004. So, a typical Democrat simply ignores both the will of the People and the state constitution to get what he wants.
