Now, lawyers want to know where the line is, and whether it’s a federal crime to execute an everyday tactical maneuver.
“I’ve done this countless times. He may have chosen his words poorly, but this is a good, honest lawyer,” said Terrence Kennedy, a criminal defense attorney and current member of the Governor’s Council who is not involved in the case. “I am outraged by the indictment. I’m outraged by the way it was handled. Criminal defense is a minefield, and any of us can get blown up.”
The indictment states, “Defendant Flaherty provided the victim with an envelope containing $2,500 cash and instructed the victim, among other things, that if anyone ‘from the court,’ contacted the victim, ‘just (expletive) ignore it because they will never bother you.’”
If the allegations are true, he may have violated certain ethical rules. But that’s a far cry from federal witness tampering — a charge that carries with it a maximum 20-year sentence. That’s enough to intimidate criminal defense attorneys who are trying to keep a case out of court.

The lawsuit, filed by Larry Klayman of Freedom Watch, includes a legal request to have the Florida judge seize the private server on which Hillary Clinton and her aides hosted their emails while she served as secretary of state.
Klayman has filed dozens of lawsuits against the Clintons and other prominent politicians.
The racketeering, influenced and corrupt organizations, or RICO, case alleges the former first couple and their family philanthropy traded political favors for donations or generous speaking fees for Bill Clinton while his wife was the nation's chief diplomat.
"Negotiations by email about influencing U.S. foreign policy or U.S. Government actions to benefit donors to ... The Clinton Foundation or sponsors of speaking engagements would not be captured on a U.S. Government email account because her emails would not be with a U.S. Government official," Klayman said in court documents obtained by the Washington Examiner

"It's a perfect RICO case, it fits completely," Klayman said of the lawsuit. "Our Congress doesn't even have the guts to subpoena her documents. They'd rather get on Fox News. So we felt had to bring that case. Somebody's got to do it."
Klayman said a major reason for his lawsuit involves the fact that Cheryl Mills, then-chief of staff to Hillary Clinton, and the secretary of state herself "lied to the lower court" in by claiming there were no documents related to a pair of Freedom of Information Act requests he filed in 2012 while knowing those records actually did exist on the private server.

President Obama’s lawyers admitted to a federal judge late Thursday that they had broken the court’s injunction halting the administration’s new deportation amnesty, issuing thousands of work permits even after Judge Andrew S. Hanen had ordered the program stopped.
The stunning admission, filed just before midnight in Texas, where the case is being heard, is the latest misstep for the administration’s lawyers, who are facing possible sanctions by Judge Hanen for their continued problems in arguing the case.
The Justice Department lawyers said Homeland Security, which is the defendant in the case, told them Wednesday that an immigration agency had approved about 2,000 applications for three-year work permits, which was part of Mr. Obama’s new amnesty, even after Judge Hanen issued his Feb. 16 injunction halting the entire program.
Top Obama officials, including Homeland Security Secretary Jeh Johnson, had repeatedly assured Congress they had fully halted the program and were complying with the order.

Judge Hanen had already been pondering whether to sanction the Justice Department lawyers after they admitted to misleading him — they said inadvertently — on more than 100,000 amnesty applications approved between the Nov. 20 date Mr. Obama announced the new program and the Feb. 16 date the judge issued his injunction.
Thursday’s filing, however, appears to be worse, since it breaks a direct injunction, and comes two months after the judge began to scrutinize the administration lawyers’ behavior after that first instance.

The incident gained public attention with the release of a 2008 video of police officers punching and kicking Anthony Warren as he lay on the ground after leading them on a roughly 20-minute high-speed chase.
Warren is serving a 20-year sentence for attempted murder stemming from his running over a police officer during the chase, in which he also hit a school bus and a patrol car before crashing and being ejected from his vehicle.
Under the terms of the settlement of Warren's 2009 federal suit, in which he accused five Birmingham police officers of excessive force, his attorneys will receive $100,000 for expenses and $359,000 in fees, said Michael Choy, an attorney representing the officers on behalf of the city.
