Competency, Disability, Homosexuality


This article raises several questions about law, competency to stand trial and homosexuality. Would the court be as lenient if the matter was heterosexual sexual abuse? Each state has different standards for competency. In some it is only knowing what a lawyer is, what a court is, and what a judge is. Competency has a very low bar. It is however a very lucrative business for psychiatrists and psychologists. Competency is a matter for the trier of fact in this case the judges, who are reluctant to leave themselves open to mistakes. They prefer to leave it to the taxpayer funded "experts" who have a financial interest. Their standards are arbitrary. It never ceases to amaze me why courts allow psychiatrists to predict the future. But they do. How many highly educated and highly intelligent people know how a court works? How many lawyers know? Not all lawyers go to court.
