Teach Students How Criminal Justice Laws Process Sex Offenses

Would it be helpful to students if a seminar by knowledgeable lawyers was presented explaining criminal procedure for sexual offenses? Then a spokesperson for HUPD could explain what their procedure is and how it differs from state criminal law procedure. Finally students may learn about the difference between a civil proceeding and criminal procedure, and that one does not eliminate the potential for the other. I.e., both criminal and civil liability arise when there are allegations of sex offenses.

College Tribunals For Rape. Civil or Criminal?

Students appear confused by the lack of transparency of this bureaucracy, and skeptical of it. Is the newest bureaucracy performing criminal investigations and findings? Or policy, i.e., administrative investigations and findings? Students need to be clear about what this omniscient academic bureaucratic utopia is doing. Are students told they can pursue their complaints criminally in addition to what the university does? Do campus police refer complaints they receive to the district attorney or to the administration? What system does the campus police use for their legal duties? What the academic bureaucracy tells them or state law?

Lawyers say the King of Pop shelled out nearly $200 million to as many as 20 victims.
Safechuck first met Jacko in 1987, when James was 8 years old. Safechuck will testify that Jacko repeatedly molested him a year later during a tour and that Jacko wrote a check for more than $1 million to Safechuck’s father, a sanitation worker.
Safechuck claims in court filings that Jacko held a secret wedding ceremony, with the young boy as his bride. He said the singer gave him a marriage certificate and a wedding band as keepsakes and confirmation of their “undying love.”

“Jackson was successful in his efforts to the point that my client endured repeated acts of sexual abuse of a heinous nature and was brainwashed . . . into believing they were acts of love and ­instigated by James himself,” Safechuck’s attorneys says in ­filings.
Jacko regularly dressed Safe­chuck in clothes identical to his and would tell reporters Safechuck was his cousin, a former Jacko employee said.
Safechuck’s attorney alleges that Jacko molested Safechuck more than 100 times.

US Judge Who Declared White House Immigration Memo Unconstitutional, Was Acting Without Jurisdiction

McCarthy's analysis is that the judge who "decided" that Obama's memorandum to change immigration law is unconstitutional, was himself acting outside of the constitution. The underlying cause of action, of the case before this judge was a criminal matter. Deportation is a civil matter. The judge did not have jurisdiction. But in these days of widespread adoption of the Obama-Holder doctrine, inconvenient laws may be ignored by selected persons, what does jurisdiction matter? The Massachusetts Supreme Judicial Court which legalized same sex marriage did not have jurisdiction over marriage. The state constitution states that matters regarding marriage are to be left to the Governor and the legislature. That did not stop the MA Judiciary, led at the time by Margaret Marshal, the former General Counsel of Harvard University. Perhaps the gentleman from Baltimore and Georgia who shot dead two NYPD officers while they were sitting in their patrol car was inspired by the same lawlessness in Washington DC and Boston. What does equal protection of the laws mean? If politicians can pick and choose which laws to obey, why not the rest of us? Laws are just for the little people. I do not think that shooter thought of himself as a little person.

Judge Schwab, analogously, has run roughshod over constitutional boundaries that limit the exercise of judicial authority. The Constitution empowers judges to resolve only cases and controversies that are actually before the court. In this case, President Obama’s decree was not before Judge Schwab — at least until he gratuitously directed the parties, who had not raised it, to address it.
CONSTITUTIONAL OVERREACH . . . BY THE JUDGE
As is typical with judicial activism, Schwab not only ignores the law in order to reach a matter he has no business addressing; he then mangles the law in addressing it.
