On August 22, 2009 at about 4:00 AM I while reading Apple Discussions on Final Cut Express I noticed a message regarding downloading a news item from TV. Tom Wolsky the expert on FCE (author of an excellent guide book to FCE 4) posted a reply saying it is illegal to download from TV and that discussing the subject was not permitted in the discussions. I cannot be certain that all posts using his name on Apple Discussions are posted by him personally. He may employ interns to help with all of the queries.

I posted a comment saying all downloads are not illegal; that Fair Use Doctrine is a defense to charges of copyright infringement. I said protect your rights under the Digital Millennium Copyright Act and gave the URL

On Saturday August 23, 2009 I received three emails notifying me of replies to my post. All are copied below. When I tried to go to the replies to answer I was directed to a page saying I was not permitted access to that message or to the thread.

I'm aware that Mr. Wolsky is an expert on FCE. But I do not think he is an expert on copyright law, Fair Use Doctrine or the Digital Millennium Copyright Act. People with law degrees, medical degrees and PhD.s are experts in their field. But their expertise does not carry over into all other fields as they believe. I was unable to find a way to contact Apple Discussions.

It's illegal to do so. Tom indicated that in his original reply.

In addition, if you were to actually read the Terms of Use on the sites (CNN and others) you will see that they explicitly assert their copyright to their materials and prohibit reuse of the materials without their express advance consent. Downloading material 'for personal use' is generally allowed (for example, to read an article at a later time ...) but copying or using any of their material including video in FCE would constitute creating a derivative work, which is expressly forbidden by the Terms of Use.

The point is, don't use other people's intellectual property unless you have their express permission to do so. Just because you can get your hands on the material does not give you the right or permission to use it.
